    Can some 1 shed some light please I'm going to send meteor the first template message in newbies section as c-m has stated, and the send the message I have created to the "debt recovery" service. Also notify dvla that details have been obtanted by meteor and passed on which is against Data protection. Is this sufficient? And writing on Monday to Toc and passenger focus.

    Yes all a good plan but I wouldn't be sending the usual template to Meteor. Hasn't one of the links I gave you above got an example of suggested wording to the PPC? If not then send them a copy of your complaint to the BPA about not offering POPLA and pretending they've issued a ticket under byelaws when it was likely to have been a bog standard 'parking charge notice'. Complain to the BPA and Metor that this is not on at all, as it denies you POPLA and wholly misstates the legal position. Write ONLY as the keeper (not saying who was driving, be careful).

    A Parking Charge Notice is not a Penalty Charge Notice. Very different animals. The former cannot lead properly to a TOC's efforts in getting the case to Magistrates court. Do re-read the links above in the other reply - the poster anon45 on pepipoo posts with a lot of knowledge in this area so read his advice.

    Don't blame you if you want to wind them up!

    As long as you don't ignore any letter from the TOC or penalty prosecution service, actually attempting to lay this before Magistrates court - which they can only do within six months. Safest time to wind them up (report them to the BPA, Trading Standards for misleading practice, etc.) is AFTER the six months is up.

    Also, as another line of attack - did the original PCN mention POFA 2012? If it did then it was mis-issued (the DVLA's term) and falls within a similar complaint as successfully pursued by prjohnsonnn against MET at railway stations. This link may be one where you can see similarities and how to step up complaints (this took prjohnsonnn months to achieve):

    What a shame. However they are still not 'penalty charges' are they. Can you confirm they are 'parking charge notices'. And nothing about 'keeper liability' or POPLA?

    Definetly parking charge notices, popla was only available on the window ticket.

    Liability to the owner/keeper/hirer.

    This really does show scare tactics.

    There are about 3 other Meteor cases on the forum at the moment in the same boat, here's one I just added a post on earlier:

    Search this forum for Meteor as a keyword, to find the others, and why not compare tactics with the other posters by pm? Why not all complain jointly to Trading Standards, and the BPA and the DVLA, the TOC and to Passenger Focus (there is weight in numbers)? It took prjohnsonnn several months to achieve a successful outcome to sort out his DVLA complaint about MET parking's misleading (but a bit different) tactics at railways stations - he recently posted his update that the DVLA has forced MET to refund and cancel hundreds of misleading tickets.

    Dears Sir/Madam

    I write to you in regards to Parking Charge Notice Number: xxxx
    As the Registered Keeper of the Vehicle I have received this “PCN” stating “Parked without displaying a valid ticket or voucher”

    As the register keeper I have visited xxxx station to check that the nature of this ticket is correct, I have studied your Agents Terms and Conditions and also read The British Parking Association Code of Practice and Compliance.
    As the keeper of the vehicle i have been denied the right to a POPLA appeal since the signage makes it clear that the document issued by post was a Parking Charge Notice which has to follow a set procedure under the British Parking Associations Code of Practice and Compliance. Failure to do so shows that Meteor are in breach of their own Trade Body rules as set out in the signage.

    Railway byelaw has been stated in this letter received by you, which is also in breach of the railway byelaw as there also needs to be the correct signage and the amount stated clearly.
    Railway Byelaw 14(4):

    In England and Wales
    (i) The owner of any motor vehicle, bicycle or other conveyance
    used, left or placed in breach of Byelaw 14(1) to 14(3) may be
    liable to pay a penalty as displayed in that area.

    Further, I am complaining to DVLA that:

    (i) your agent Meteor obtained my personal details from DVLA and then passed them on to another company (you) in a prima facie breach of the Data Protection Act, I will also be writing to the Information Commissioner's Office in regards to the breach of the Data Protection Act.

    I also demand the original 'Parking Charge Notice' as I feel no compliant document was ever issued by Meteor you agent on site.
