    Whilst Northern Rail and EMT have brought many byelaw 14 prosecutions, (despite typically not having any evidence at all as to the identity of the alleged offender, being the driver), I am not aware of any prosecutions at all being brought by either DRPS, Southern, or Southeastern.

    Indeed, freedom of information statistics:

    suggest that no such prosecutions have ever been brought by the said DRPS, Southern or Southeastern, at least during the period in question.

    There are numerous threads on Pepipoo where DRPS threaten that the RK will be prosecuted if the invoice is not paid, the RK/OP ignores, and then never hears anything further at all.

    In short, I suggest that DRPS are bluffing, and that their hollow threats of certain prosecution following non-payment amount to both an aggressive/ misleading commercial practice and a fraudulent misrepresentation.

    Thank you for that link - good info there and I happily stand corrected. :) Certainly better news for the OP.

    Its doesn't change the ridiculous legal situation that DRPS are apparently putting themselves in. If in fact that are using the threat of criminal proceedings as as means of brow-beating the recipients into settling entirely mythical debts then somebody would seem to be baring their rear end for a serious kicking. With that in mind one is tempted to recommend that staff at DRPS cast their eyes over s.21(1) Theft Act 1968. Presumably they are doing what they are told and may have a defence but those in positions of being the "controlling minds" could conceivably be counselling or procuring the actions of their staff? An even more serious mistake it would seem.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Hi guys sorry I haven't replied I was moving in to my property and totally forgot about this ticket my mums received another letter from the PCN DEBT RECOVERY AND PROSECUTION SERVICE. It now says "DO NOT IGNORE THIS NOTICE"

    That's all part of the standard 'scare RKs into paying' letter chain, which everyone who has not fallen for their little ruse gets, and which in no way indicates that you will actually be prosecuted.

    No I thought I'd take anons advice and just ignore them but I wil be complaining to trading standards today. I've written to dvla. I can't find anything in to writing to passenger focus.
