    I've had a email from the BPA today,

    Dear xxx
    !
    Many thanks for your e-mail, the contents of which are noted.
    !
    I believe that we should look into this matter for you and by copy I am asking my Operations Manager to initiate an investigation for you.
    !
    I know that David will be keen to receive copies of as much of the correspondence that you have exchanged with Meteor and I would ask that you send this to him at your earliest convenience please.
    !
    I note your contention that Meteor may have breached the !Data Protection Act !but I would say that as they have only used the data for the purpose for which it was obtained, namely in the pursuit of an outstanding parking charge, there is no breach. However I am sure that Dave would like to understand which clauses of the DPA that Trading Standards believe that Meteor have breached.

    But the thing is there has been no correspondence with meteor just with drps?

    I wouldn't worry about it, BPA Ltd. is the least important of your complaints. The only reason they are pretending to investigate at all is that you've got TS on the case. Normally a BPA member could slaughter a hundred motorists with a machine gun and BPA Ltd. would say there was nothing wrong with it.

    The only reply I would make to that is "I have passed your details on to Trading Standards, I'm sure they will contact you if they see the need."

    Thank you for your e-mail, which has been forwarded to me to answer, concerning the release of DVLA data.
    !
    DVLA takes very seriously its duty under the Data Protection Act (DPA) to protect the privacy of the motorists whose details it holds on its record. The DPA does not impose an obligation to seek consent from a data subject if the law requires the disclosure of personal data.
    !
    Regulation 27 of the Road Vehicles (Registration and Licensing) Regulations 2002 allows DVLA to release information from the vehicle register to the police, to local authorities for purposes associated with the investigation of an offence or decriminalised parking contravention, and to anyone who can demonstrate ‘reasonable cause’ to have it.
    !
    The release of information under this legislation is not based on the consent of the data subject. Regulation 27 provides a legal gateway for the release of information. Disclosure in these circumstances does not breach the Data Protection Act and the Information Commissioner’s Office is fully aware that data held on the DVLA’s records is released in this way.
    !
    There is a range of safeguards in place to help ensure that motorists are treated fairly when any parking charge is pursued. Vehicle keeper information is disclosed only to companies that are members of an Accredited Trade Association (ATA) and adhere to its code of practice. The British Parking Association (BPA) is the approved ATA for Meteor Parking Ltd. Its code of practice is published on the website at https://www.britishparking.co.uk under the heading “Approved Operators Scheme”. If a company fails to comply with the code of practice, it can be expelled from the scheme meaning no further data will be provided to it by the DVLA.!

    If you feel that any of the actions taken in this particular case contravene the code of practice, you should contact the BPA at Stuart House, 41-43 Perrymount Road, Haywards Heath, RH16 3BN.
    !
    The DVLA accepts that some companies use debt recovery agencies to recover unpaid parking charge notices. The information provided to the private car park enforcement company is passed to the debt recovery agent to initiate civil proceedings. The DVLA would be concerned if information were to be used for a purpose other than that it was requested for. If this were to occur, the DVLA would ask the Information Commissioner to investigate the matter.

    There is no record of DVLA data being passed onto PCN Debt recovery by the DVLA, however, If you believe that your information is being passed by any company to any unauthorised third parties, please could you provide full details and supporting evidence (such as notices and correspondence) which shows that this is the case.
    !
    DVLA is mindful of the importance of making individuals aware of the circumstance in which their data may be released. Data subjects have the right to request that information held about them by the DVLA is provided Requests for information from the vehicle record must be made in writing providing full name and address and details of the vehicle registration mark(s). The fee for this service is £5.00. Requests should be sent with any necessary documents to: Vehicles Fee Paying Enquiry Section, DVLA, Swansea, SA99 1AJ.!

    Can you please provide a copy (to this email address) of the parking charge notice, your letter of appeal and any other correspondence sent and received between yourself, the parking operator and any third party. This will enable us to look into this further for you and advise accordingly.



    If we receive evidence of a possible breach of the BPA Code of Practice, during our investigation we request information and amendment of any point/s necessary for correction and request evidence of these having been done to retain membership.

    We have internal processes and a Sanctions Scheme that is applied to all parking operators within our membership and carry out annual audits to address any issues that may arise.



    Please be advised that as we are a membership association and not a regulatory body we have no authority to cancel parking charges, intervene in the parking charge notice procedure or recall parking charge notices referred to debt collection agencies. We can however, assist in the rectification of a breach of The BPA Code of Practice.
