    Hi all

    I have appealed and received no response from the PPC as they said they did not have my address on the letter I sent.

    So they have ignored my appeal and passed straight to TNC Parking Services (who had no issue finding my address and bombarding me with daily letters, sometimes 2 in one day!).

    I called and asked for a response to my appeal. Was told they would send a letter and tell TNC to put the case on hold.

    Received no letter from PPC but continued to receive letters from TNC demanding £140.

    I then called PPC again and rude man told me they would email me a response to my appeal.

    Again received nothing.

    I have reported Nighthawk Parking and TNC Parking services to BPA and DVLA. But I have no POPLA code to take this further?!

    Any ideas what to do next? The latest letter from TNC Parking services states the following :

    Outstanding Parking Enforcement Notice

    Dear XXX

    A parking notice relating to vehicle XXX Reg XXX was issued at Dec 09 2013 at XXX.

    Despite our letter of 01 March, 2014 the above parking notice has still not been paid nor have you advised us that you were not the owner nor the driver of the above vehicle on the date stated. If within 28 days of the issue of this letter you fail to provide us with details of the driver at the time of the incident then under the terms of schedule 4 of the POFA 2012 you are liable for this Parking Charge as the vehicle keeper at the time of the incident.

    Your options are now to immeadiately advise us that you are not the correct person to pay the parking notice.

    Failure to act today by contacting TNC Parking services or paying will result in the immediate referral of the matter to our Litigation Department.

    On the back it states what Litigation means and now I am really worried! Any help appreciated.

    Complain to the BPA that you have reported this incident to them but have still not received a POPLA code. The email address is in the newbies thread. Make sure you send them copies of all the notices you have received and sent.

    Thanks have already reported to BPA, received a standard response but have today responded advising I dont have the POPLA code etc.

    Hopefully they actually read this email!

    Another point - the litigation section - can they actually issue a CCJ? Says on their letter they can!? Im really worried now!

    No they can't, the parking company would have to take you to court and win to get judgement. If you then ignored the judgement you would get a ccj.

    OK thanks for clarifying I didnt think they could but its all getting scary.

    Have sent all off to BPA.

    You should respond to TNC :

    Dear TNC

    Re - parking notice relating to vehicle XXX Reg XXX issued at Dec 09 2013 at XXX.

    Despite attempts by the Registered Keeper to appeal this notice with your client Nighthawk, no correspondence has been received. Your client has failed to follow the BPA Code of Practice and has therefore rendered the charge invalid. This failure has been reported to both the BPA and the DVLA.

    Any liability of the charge is denied by both the Registered Keeper and the driver. Therefore you should return the charge to your client, Nighthawk.

    Any further correspondence except a cancellation of the charge or a POPLA code will be considered harassment and could leave you liable to legal action. No further correspondence will be entered into by the Registered Keeper.
