    Said they are legally entitled to call me 3 times a day chasing payment!

    I told them I am going down the BPA complaint / DVLA compaint / then POPLA when I get a code route, he said ok I will pass this case back to Nighthawk!

    Actually they can only phone you three times a day if they don't get an answer the first two times - clearly they don't understand either OFCOM or BPA rules !

    OK guys this is what I received from Nighthawk

    Dear XXX


    Parking charges xxx issue date xxx at Location: xxx

    We must advice you that Nighthawk Parking has received the appeal letter dated 10/12/2013. A
    copy of appeal is enclosed to the e-mail. Your appeal has been denied; however no response has
    been sent to you because on the letter is no name and no postal address where to send our
    decision to.

    Your appeal has been denied on the grounds that the area where your vehicle was charged has a
    policy to which all attending vehicles must park within the pre-informed parking criteria. The
    contravention you have been breached with specifically is for:

     No Parking permit on visible display

    Please be informed that the parking charge notice was correctly issued under the power given to
    us by the landowner.

    Nighthawk Parking did not hear from you within 28 days after the date the parking charge was
    issued and all details have been passed to TNC Collection service that is in title to obtain vehicle
    owner details from the DVLA.


    You can do whatever action you feel necessary to do; however please be informed that TNC
    Collection Service will continue the procedure of chasing the payment.

    This matter is no longer with Nighthawk Parking and we will not be corresponding to this case any
    further.

    Really ? What a load of cow poo they speak !!!!

    Please could you just confirm you sent the email I suggested to TNC but Nighthawk responded ?

    EDIT - under BPA rules nor POFA is there ANY requirement to supply a postal address or a name. They clearly DO have details to contact you as they have emailed you !!! How stupid are these people ?

    I sent this to Nighthawk:
    To Whom It May Concern



    I am in receipt of a PCN Reminder from TNC Collections which relates to the issue, by you, of a PCN on xxx. I am the keeper of the vehicle concerned, registered number: xxx



    Schedule 4 of the Protection of Freedoms Act requires that in order for you to make use of the keeper liability provisions you must deliver to me, within 56 days of the alleged parking event, a Notice to Keeper. This you have not done. Whilst the Act allows for a presumption that delivery of such a notice would be effected two business days after posting it also provides that this presumption will stand unless the contrary is shown.



    I assert in the strongest terms that I have received no correspondence from you and most certainly I have received no Notice to Keeper. The first indication I had of this matter was my receiving a letter from the debt collectors to which I have responded separately.



    I also was informed I would receive a response to my appeal in writing last week. I did not receive this. I was then told I would receive an email with your response. Again this has not been received.



    This means I have no POPLA reference number to take this further.



    In view of this, I therefore invite you to withdraw the parking charge notice or supply the POPLA code as soon as possible, as per the terms of the counterclaim clause.



    I have received some odd letters from TNC, some dated many weeks ago, which seems unreliable. I have also received the same letter twice in one day. The original letter from TNC is extremely misleading and I have now reported this issue to both the BPA and DVLA for breaching code of practice by not following BPA guidelines or allowing the registered keeper to appeal.



    If you do not do so I must warn you that should you or your agents or assigns (this specifically includes TNC Collections) continue to pursue this unwarranted matter then I will hold you liable for my time (at the Court approved rate of £18 per hour), and for my reasonable expenses incurred in dealing with and researching my position with regard to this matter. Such expenses may include, but are not necessarily limited to, transport costs, photography, printing, photocopying and postage. Acceptance of these terms will be determined by your conduct.



    Please note your email address stated on your website does not work. I hope this email is received appropriately.

    and similar letter to TNC - who called me - on the phone with TNC they said they can call 3 times a day until they receive payment, I gave them some legal speak and said I have not received a notice to keeper, POPLA code etc and they apologised and said they would pass back to Nighthawk. But nighthawk have said they will no longer correspond?

    I would like to add the photo's they sent are not clear that my permit was not showing. Parked in my space in my home :(

    See what others say but given TNC have passed it back to Nighthawk ( keep that email ! ) and Nighthawk are saying they are effectively not accepting any responsibility for the charge ( keep that email too ! ) then I would now leave it.

    If you get any correspondence from TNC then just send :

    "You said in your email of xx/xx/xx that you had returned the "debt" to your client Nighthawk. You have clearly lied so I will now be ignoring you".

    Anything from Nighthawk then send :

    "You stated in your email of xx/xx/xx this charge was no longer with you. Therefore I have nothing to say to liars like you."

    And just get on with your life. If ( and that is an ENORMOUS if, you get court papers then come back for help ).

    Prod Steve Clark of the BPA again to show them the latest drivel and to point out you have now appealed twice, once as driver and once as keeper but are still being denied a POPLA code by a firm which doesn't even issue NTK letters and goes straight to debt collector threatograms. How is this operation BPA CoP compliant and how is it fair that a PPC can issue windscreen tickets then routinely ignore registered keepers, just because they farm their paperwork out to a debt collector at a stage when they should be issuing a NTK as part of the appeals stages?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
