Hi all
After some advice -
Was parked in my space at my flat I rent. However the paper permit they give you had fallen off my dash.
I park in this space all day everyday. You cannot have visitors at the flat as its all permits for the 9 spaces and even though many peoples families park in the car park in the 1 spare unmarked space, people continue to get tickets.
Anyway, I appealed - sent copy of PCN (illegal!) and my rental agreement, details of parking space and copy of permit.
Stated all of the usual breaches they were making. Heard nothing.
Three months later I received two IDENTICAL letters dated the same day from T N C Parking Services.
Then I received two more the next week.
I called Nighthawk and they said I didnt include my address on the appeal letter so they passed to TNC. But I still dont know if my appeal was accepted or not?
Also the letters from T N C are very poor and im not sure they are even legal?
They send one every week, often two on the same day which is odd.
Do I have any chance or am I best to pay what is now £140.00?
I dont want to given I was parked at my house in my space?

I am checking out the thread now.
Nighthawk Parking never responded to my appeal and when I called them one lady said she would send a letter but I never received it. She also said she would tell TNC to put the issue on hold but have received two more letters from them. Called again and the man was so rude and mean. He passed me to a woman who said she will email me but nothing. No email / letters received. No POPLA reference. Nothing.
Just plenty of crappy letters from TNC.
I am a little worried TnC will affect my credit rating or something like that but I dont want to pay for parking in my space.

and you havent complained to the BPA because ? .......................
TNC and P4 Nighthawk are BPA members and TNC do the back office work for Nighthawk afaik
so as you have not had any appeal details or popla code, then why have you not complained to the BPA about a breach of their CoP
or a complaint to the DVLA ? ( if the dvla was used to access the RK details ? )

Its my fault because I did not give them my address so they said they could not reach me.
Yet found it pretty easy to pass to TNC and reach me to demand £140!
BUT I then called them and gave my email address which they said they would send an email to but never did.
I will go the BPA route now.
Yes DVLA was used by TNC - not sure if thats legal but seems to be what goes on.

read through that thread I linked to and see how much difficulties they were having with similar circumstances
the dvla was used to get the RK details, hence how they got your address etc, that is standard in this industry at the moment
so the driver appealed and was fobbed off , then the RK was contacted after accessing the dvla database and yet no popla code was provided despite your appeals
so complain to the BPA and the dvla because you have not been given any popla codes when the refusal was sent out and therefore the BPA CoP was breached
also check your paperwork for any other breaches , like POFA 2012 etc
the more breaches they make , the better for you0 -
Thanks - the letter shown on that thread is the same as mine. Also back dated as keep receiving letters dated in Feb this week?!
Do I need to include my address on these letters BPA / DVLA so they can reply? I know they have my address as it is! Just wondered0 -
I think they missed my point?

Many thanks for your e-mail received concerning the parking incident you experienced with P4 Parking (UK) Ltd T/AS Nighthawk Parking.
The Approved Operator Scheme and its Code of Practice was developed by the BPA to bring a degree of regulation to an industry without primary legislation. Regrettably as we are not a regulatory authority, we are not empowered to become involved in individual disputes between you and the car park operator and have no power to overturn an operator’s decision. Therefore, any action regarding your individual circumstances are out of our control and should be directed directly to the operator. Although we sympathise with your predicament we have no power to get an operator to cancel or refund any parking enforcement charges.
Having said that, I would be happy to make contact with the operator concerned to seek to determine whether they are non-compliant of our Code, as this operator is a member of the BPA. To do this I would need to be provided with some items of information including the incident number (which should be in the receipt for payment or on the Parking Charge Notice), vehicle registration number, date and location of the parking incident and copies of any correspondence which may have been exchanged.
If a member is found to be non-compliant of the Code, they would be subject to our Sanctions Scheme, where Operators who are non-compliant the Code can expect to receive a number of penalty points depending on the severity of the offence. As with driving offences, once an operator’s ‘licence’ has reached twelve points in any given 12-month period, then they are likely to be faced with suspension or expulsion. The Code of practice can be reviewed on our website;
However there is a process for you to follow if you feel that the ticket has been wrongly issued and is seeking to get it cancelled. This would see you initially appeal to the parking operator setting out your reasons for challenging the issue of the ticket. If the operator rejects this challenge then they are required to give you, the motorist details of POPLA – the independent appeals service for parking incidents on private land. This is a free service to the motorist and the decisions of the adjudicator are binding on the operator.

That email is a standard template - we saw it verbatim the other day and in fact the BPA had got in touch with the PPC (we know that, because the PPC suddenly cancelled!). I would reply and say 'I have given you all the information & their letters as attachments already, so please investigate why the PPC never sent me a POPLA code. They are saying that I didn't provide my address, but I gave them my rental agreement, details of parking space and copy of permit and my name so they DID have my address an details from that.'
By the way if you get a POPLA code in the end, I hope you've read 'How to win at POPLA' in the NEWBIES sticky thread and realise it's nothing to do with sending a permit or proof of your parking space allocation. You'd lose at POPLA with that sort of appeal but you'd win with ours!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I do realise I need to take a different approach to win at POPLA.
This is all very messy. Maybe I should have included my address on the original appeal letter.0 -
Also I emailed Nighthawk a letter of complaint as per your templates and it seems their email address does not exist!
