Well, I'm eligible to defer, which they acknowledged, but they've just put account in arrears as I won't sign the damn form.

Not got dd set up either which appears to annoy them as they say it is a breach of my agreement.

Just emailed my (Labour) MP- hopefully she'll get her teeth into it. Will also phone FOS tomorrow.

    *sigh*

The term 'bigger raid' is rather worrying - I thought the repayments could not exceed the balance, divided by 60 months? I've just turned 59 - I hope they're not going to attempt to remove the whole balance is 12 payments. I shouldn't even have to consider that option, as my only income is in the form of support from my wife and is way under the threshold. How the hell are the authorities allowing them to continue acting in this way?

I'm in a similar position to you. I only worry about a 'bigger raid' because they've already taken money from me without warning or even discussion.
There is very little chance I'll ever be earning over the repayment threshold, even with a well paid job of my degree course subject! I don't know why we can't be trusted any more!

I have been reading the various threads on Erudio here with interest as I am about to complete my deferment form and am not quite sure how to proceed. My current plan is to keep it simple and give them minimum information and let them ask for more if needed.

However, I am stumped by having to sign the form as I don't agree to them putting my deferment on a credit reference file - I'm nearly 50 so was looking forward to having it written off soon and the weight off my shoulders. Instead, a note on my credit file would be a long-lasting reminder that could affect my credit rating.

Is there anyone with a deferred loan who has actually seen that information on their credit file? I wonder whether this is just one of Erudio's scare tactics and actually they are not doing it?

Any feedback from others in the situation would be greatly appreciated. Thanks!
    :)
  • Unfortunately I sent in my forms, payslips and bank statements I earn under the gross amount BUT Erudio say I cannot defer as my child benefit takes me over the threshold! I haven't had a pay rise in years now 2 kids later they think I can pay this?! Apparently my payment is on hold for 28 days while they send me a budget plan.... They said I can cancel my DD but it would be reported as a deferment. I'm going to complain to the F Ombudsman but I'm pretty much up sh1ts creek without a paddle

I got my successful deferment through ftom Erudio on 2nd June. Interestingly the letter was dated only 2 days after they had received all my supporting evidence again and a letter telling them I had gone to the FOS..

all fine and good, or so I thought.

Got home from work on Friday to another letter from erudio along with a new application form saying I hadn't signed and dated the one I had sent. This letter was dated 2 days after my deferment letter!!!

They really do not have a clue what they are doing.

Someone on the mumsnet thread had the same thing. Hold on the the first letter as you are deferred whether they like to or not, and be prepared to make another separate complaint to them and the FOS.

Seems their previous track record of being totally incompetent is not enough for them. They are trying to beat it.

What academic years did you take out your loans? Depending on those it may make no difference anyway. 1990 to 1997 loans have that clause that supposedly allows it regardless of the forms.

If you have some loans from 1998 and after you could blank out the parts giving consent and include a cover letter setting it out clearly that you do not give consent and that your completion of the amended form must not be taken as any sort of agreement to reporting.

From reading these threads - it looks like 'forgot to sign and date the form' is their favourite delaying mechanism. Is that really the best they can come up? If the FOS get over a certain number of complaints about an individual organisation, doesn't it trigger some sort of higher level investigation?

    my story boils down to
had to send direct debit info, been putting off for years as id closed the old account but SLC never complained but i didnt trust erudio not to or most likely use it against me as breach of contract.

My first application as turned down as i didnt have any proof of child benifits - lost the award letter.
Follow up strongly worded letter with copy of wifes bank statement (mostly blanked out) was accepted and theyve accepted it as a complaint and will respond blar blar....

I still dont trust them but at least i dont have to worry about it now till next year.
Mine should be about 14 years old now so half way though getting it wrtten off cause i doubt ill ever earn over the threshold.

    Good luck to everyone!

    Thanks, fermi.

I do have have three loans: one from 1996, 1997 and 1998. So you're saying there is nothing I can do about the first two? Re the 1998 one, I will do what you're suggesting.

I am also wondering whether anyone here on the forum has had their deferment from Erudio and actually seen the deferment recorded on their credit file?
