    According to the ICO and BIS the terms of the 96 and 97 ones would allow the loans to be reported regardless of what you do now.

    Don't recall hearing of anyone reporting that deferments are showing up on credit files yet.

    I've just been trawling through some of the Erudio posts on MumsNet and came across this, which made me feel a little better (apologies for copying from somewhere else if it's not proper etiquette):

    "Hey all. Glad to catch up on round 3 of the Erudio fiasco. Don't be put off taking Erudio to court. I am planning to do so and now bunkered down for the long game. Also, planning on making a complaint to the Parliamentary and Health Service Ombudsman about the shocking way we have all been treated by the Dept of BIS. They have lied and covered up their total incompetence. Btw. Direct Debit instructions are automatically cancelled after a year by banks if no monies are collected. KEEP STONG"

    Please don't just accept that Erudio has the right to disclose the data on your older loans - the term in the loan agreement states that any disclosure is subject to the provisions of the DPA.


    You've nothing to lose by making a complaint to Erudio then taking it to the Financial Ombudsman Service. Let an independent adjudicator decide, rather than a body/department that reports to Government!

    @ GirlGeek There's a 13 month dormancy period operated by the banks, after which any inactive DD's are cancelled by them, more info here:

    Does that mean that the bank also removes them from your list of DD's? I've usually had to remove old ones myself. And as my original DD agreement with SLC was over ten years ago (if they set it up or not, don't think they did) and Erudio took money from my account by DD the last two months without notice or a signature agreement to a new DD from me then my bank aren't using the 13 month dormancy period. They did refund me under the DD guarantee though.
    If I close my eyes and hum loudly will this all go away? No? Didn't think so!

    Hi,
    I received my Erudio deferment forms the other week, giving me until the 14th of July when my deferment period is up. Post is slow to Italy!
    My circumstances are that I am a house husband, here in Italy, looking after the children while my wife works and supplies the only income, which is below the threshold.
    Up until my last deferment, with SLC, I have been supplying them with only a letter stating that my wife is the earner and that she is supporting us ‘to no more than £2204 per month’ and all has been well with this.
    Erudio now have my loans from 16/12/1994, 22/11/95 and 30/10/96.

    My questions:

    1) Send exactly the same letter/info as above (adjusted to £2398) and wait for their reaction?
    2) Only fill in 1a DOB , 1d Yes to address correct, 1h&k Tel number/Email(?), 2a Yes to current account, all other financials Zero or N/A? Therefore, no NI, Address status.
    3) Complete the direct debit as I’m pretty sure they have nothing on me for that? Cancel later?
    4) As mentioned in other recent posts, should I still edit their T&C’s even though they are in their rights to credit check etc my pre ’98 loans? Which parts should I blank? All parts on page 5 and 6 or only part?
    5) Do I sign/date at all or do it with T&C edits?

    From reading this thread over the past couple of days my gut feeling says; supply letter, complete all above mentioned boxes (maybe not Tel/Email), fill DD, edit T&C’s and sign/date.

    At the end of the day I am willing to play hardball but an easier route is always welcome.
    Your advice, please, on my choices.

    @ GirlGeek If Erudio set up a new DD using your old mandate to SLC, it's not a valid instruction, as the mandate should show Erudio as the payee.

    The DD details are uploaded by Erudio via Bacs, so as far as your bank is aware, it's a new DD and the dormancy period won't end until 13 months after the DD was set up on your account. I don't think the bank sees the actual mandate, it's all done electronically via Bacs.

    I know people have been caught out with the dormancy period before, thinking a DD's still in place as it shows on their DD list on online banking, but it has actually been cancelled by the bank and no payments can be taken against it.

    Edit: Also, taking payment without giving advance notice of when and how much, is breaking another DD rule... Might be worth people letting Bacs know, as I think Erudio have to be authorised by Bacs to use the DD scheme?

    @anna2007 I'm sure I shall be phoning my bank again when the next wrong payment is taken, so I'll make sure I mention in more detail what's going on. They didn't seem to care what had happened just that it shouldn't have. I'm hoping that the bank will get fed up having to 'investigate' wrongly taken DD's from the same people again and again (one of my reasons for not cancelling the DD).

    I'll get onto the BACS people too :D
  • Some older threads have been so useful regarding the question of DD and whether or not Erudio (whoever they really are) are entitled to MAKE you set one up. This is from an earlier poster. Apologies for not putting a name, It's roughly around page 27....It's a copy of a letter someone received from Erudio...
    "As it is your intention to defer your payments for another year, once your completed deferment application is received, processed and approved, then the end date of your deferment will be amended to 2015, therefore holding any direct debit payments for a further year.
    "If you do not wish to have a direct debit set up then please advise us as this is not essential to your deferment application, but it is important that you are aware that should your account revert to payment, then you are responsible for ensuring payments are made by the due date".

    Very useful precedent? I am about to make a payment for being one month in arrears. I have missed the deferment by a few days due to bereavement and also having to research the unusual nature of these new forms. I am going to do it by the bacs numbers they have given me. Does anyone know if they can trace my bank details that way. Probably not, but you never know these days just how lawless they will be. I will then apply for deferment via their form but give only the info required for deferment, nothing extra.

    Just thought I would post an update with my deferment of 2 eurido and 2 Honours loans - I had the normal Pack off the SLC which confused me as all the information I had suggested Eurido would be handling the deferment - anyway as pointed out earlier this is not the case for me, i sent the deferment pack back with 3 payslips on May 25- called Eurido last week and they confirmed the deferment was approved on Mat 29th!

    So If you have mixed ownership loans, nothing has basically changed regarding deferment..... for now.

    Would have been nice for Eurido/SLC to point this out though as the "welcome" letter from Eurido was the same as everyone else. The whole situation has been badly handled.

    Also assume as I have not signed to agree to my details being passed to credit reference companies then they wont!
