This is what baffles me about this company - according to a post above (no. 781) - Erudio have stated that they don't suspend payments whilst a deferment application is pending - they just seem to be making stuff up as they go along.

Not only have I made a formal complaint but I have a letter stating that 'all collection activity will be suspended until we have issued our final response'. The people I spoke to today didn't seem to believe me and kept saying that payment was taken as my deferment was rejected and they don't stop taking them while there's an ongoing complaint.
They did admit that they didn't send any notification of the direct debit though so presumably even if they don't sort out a refund for me I can at least get the money back under the DD guarantee.
@Jonez - exactly, they just seem to be making it all up as they go along and are completely inconsistent. I was previously told by a team leader that he could cancel my DD if I preferred to ensure no money was collected, today I was told that they shouldn't have said that as that would mean I would now be in arrears.
I have also seen a post on Mumsnet from someone in the same position with a shared rental income and they were granted deferment on the basis that only 50% was theirs so there can't actually be a blanket policy of doing this at all.

@ ptolomy You could contact the FCA and the Credit Services Association for help - both say that collection activity must be put on hold when there's a dispute over the debt and Erudio are supposed to abide by their rules.

Did they tell you in advance they would be taking the DD payment ptolomy? Shame it has happened but it is a plus for you in getting it sorted out quickly and with the full weight of the law on your side!
It is a fact that they do suspend collection activity before, or have to by law, but that should give them the necessary time to process your deferment before any payment is due.
In the future they have to get this deadline issue sorted out, giving us the necessary amount of time to receive, fill out and then return the forms. The date of the first payment MUST be after the amount of time they say they need to process each deferral and the date we have to return the forms by. They said they would come on this site for advice on the new deferral forms, but this is more important i think.
If an individual did this they would be in deep doodoo with have just about every law enforcement official in the land on to them, so how is that that this proven bunch of ill prepared clowns are still being allowed to operate without super strict regulation given their rather abysmal record. Lets not gloss over that Zack Lewy directly lied to both BIS and on the BBC about just 50 people having DDs taken, before coming clean after a sever toungue bashing from BIS and finally admitting to over 500.
Incidentally, Erudio seems to be a topic of debate on You and Yours on BBC radio later today! Maybe someone will mention this clear lie, or challenge them on it if Lewy decides to leave his vultures nest and bless us with the logic of how the debt market has evolved to allow cretins like him loose on the general public, via our being duped into what we believed would remain a government backed student loan that i doubt any of us in our wildlest dreams would have thought would be sold off!

Just listened to Radio Four's You & Yours, IMO they didn't get to the real problem and over all didn't seem that bothered. Amongst stories of fat dogs and recycling it's not really surprising, the whole programme sounds like tabloid news for 'less switched on' people.

That was exactly my reaction to the show. Wish I'd not bothered and just stayed listening to Test Match Special.......
