  • The reason why Erudio are interpreting the 1998 Student loans act in this fashion is to set a new precedent i.e ignoring the fact that my gross income is below the threshold . If you read through the threads on Mumsnet or on this site, you will find countless examples of Erudio refusing to defer even when it is crystal clear their income is below the threshold. Therefore, they are trying to set new precedents since it is not in their interest to defer. Debt companies do not make profits from following regulations, they bend them to suit themselves . When they are not challenged, they will push and push, just as they are doing now. I have proved beyond doubt that my income is below the threshold. They will not except this, which is why I and countless others are taking them to the Financial Ombudsman.

    As you say, Erudio are bending the regulations to their own advantage, but they're not breaking them by demanding more evidence.

    If you've proved beyond all reasonable doubt that your income's below the threshold and they still refuse deferment, then they have broken the regs and you take it to the FOS.

    First experience of dealing with Erudio past couple of weeks. Not good is it folks? :(

    Feel sorry for everyone out there having to deal with this company. I realised they hadn't sent me a deferment form and contacted them. Nothing came in the post. I emailed them and asked for an electronic version. They sent me a wonky scanned form ;) without a cover sheet.

    Completed it and sent it back with PDF evidence and a cover letter explaining current work situation. I work part-time and recently switched employer which makes it a bit messy for me with holiday payments, etc. Double checked all forms and even told them my bank details again, just in case they haven't got the info from SLC. Don't want to be defaulting on a missed payment or anything like that.

    In fairness they were quick to respond to both emails, but insisting I resubmit my application and will only consider it if I put my full name (change of name if applicable), d.o.b and address on the email. They are just like a debt collection agency I had the misfortune of having to deal with once upon a time. They mentioned a Loan Pack ID? What's one of those? It wasn't on the Notice of Assignment in March so I just sent them my SLC Account Number.

    Called Thesis about my deferment application and evidence and they are like a dream. Can't help you enough. They even advised me to keep things simple with Erudio. They suggested it is more complicated for people getting odd bits of benefits here and there as they want to see every little shred of proof.

    After reading the posts here I'm inclined to agree Erudio on a mission to up the claw back on all deferred accounts and if that means a few sneaky mis-payments here and there they will do it.

    I did ask them in my email if they would let me know if they plan to pinch my pennies and how I might claim it back should my deferment be successful. :) Let's see how they answer that one in the next few days?

    It is all a bit messy isn't it? My heart goes out to you all it really does. Keep fighting!
    Former MSE user - I don't post on MSE anymore, or respond to PMs. I would like to be able to officially set profile to "former user" which would be helpful as it seems you can never leave MSE - just choose not to use it!

    Yes Erudio are debt collectors.

    They will use every dodgy tactic they can to delay or deny legitimate deferrals.

    Calling them scum would be a dire insult to the green stuff on ponds.

    Couldn't agree more. They make loan sharks respectable.

    I finally received a letter from them today dealing with my complaint of taking DD's incorrectly, not informing me that my loan had been sold and the onerous deferment application form. They say they let me know about the sale of my loan and enclosed the original letter as evidence but no letter was enclosed. They apologised for all their mistakes but will not alter the deferment form.

    In my opinion, the sale of loans under the "same terms and conditions" means the same deferment process.

    I'll have to fill out two separate forms for my loans, even though the SLC and Honours student loans were happy to work together with the same one.

    They've breached the contract for most of us and I think we ALL need to complain to the Financial services authority to make them take this seriously.

    I thought if you had loans with more than one 'company' only one body could agree your deferment for both?
    I've been waiting a week now for a response to my letter informing them I have proof of deferment until 2015 from both SLC and Erudio and their holding that I'm not in deferment is wrong.

    I asked the manager at Erudio and she said that I'd have to fill in two forms in future, one for Honours Student Loans and one for Erudio. I even argued saying that I cannot possibly send original documents to two different places and she said they would accept a photocopy of my payslips, etc.

    And it took me 8 weeks to get a response from Erudio and they only replied after I contacted the FSA.

    Yes. See earlier in the thread. 'Should' be SLC doing both.

    I don't think you can believe or trust a word anyone at Capita/Erudio, even a manager, says on the matter. Their track record on providing accurate information is worse than Tony Blair and his 'dodgy dossier'.

    SLC do the deferments for anyone with loans already sold to thesis or honours. That is confirmed.
    erudio are lying. if they lie and you record the conversation, what does that mean?
    Can you take them to court?
