She never had a direct debit set up with SLC so Erudio do not have a direct debit set up with her or any of her bank details.

So, do we now just tell them to jog on or bury our head in the sand? Not sure what to do now rather than writing a letter asking them to defer as she has met all the criteria.

Well I would suggest not setting one up, I think it is a complete red herring that not having one while you are in deferment puts you in breach of conditions. Erudio may consider it a breach but that is just their opinion and it doesn't mean it is the right one (hint. examine the T&Cs)
Anyway if it ever went to court there are lots of newspaper articles about how erudio just dip into people's bank accounts so you are well within your rights not to have one set up.
Ask for their bank details and tell them you will pay them when you earn enough to and until then not a penny!

Dont worry, she wont be setting one up! As far as my wife is concerned she's done everything and is adamant she is not signing the form so she is now not bothered and is basically forgetting about it. I just want to try and get this deferment out of them as she is within the limits and she has provided all the evidence they require

Funny thing is, on the letter she got back from them, there was no mention of not having a direct debit set up, it just said that she needed to sign their form

Exactly! Why waste time with them? Keep your end of the bargain, if they don't defer you complain, if they are still being awkward use their arrears letters as fire-lighters!

Breaking news!
Someone else had money wrongly taken from their account.
Erudio claim they never received the deferment pack despite it being signed for in April!

I think this is quite simple at the end of the day.

Cancel the DD.
Have your evidence that you earn under the threshold and proof you sent it. (show you made a reasonable effort but don't go overboard)
Refuse to pay any made up arrears but always say once you earn enough you will pay.
Let them take you to court if they want.
Win!

Anyone see anything wrong with this approach?

I wasn't aware of this until last night, and can't find any mention of it further back in the thread, but the Commons Select Committee for BIS have a current inquiry into student loans - it's looking at both the sell of the pre-98 loans and the proposed sale of newer loans. Details here:

http://www.parliament.uk/business/committees/committees-a-z/commons-select/business-innovation-and-skills/inquiries/parliament-2010/student-loans/

The status of the inquiry is showing the evidence sessions are closed, and the report's in preparation, but it does say that you can contact the Committee Clerk once the session's closed, his name's James Davies, the committee's email address is biscom@parliament.uk

If everyone took 5 minutes to email the committee with your concerns/complaints about Erudio, there's a chance we can make the committee aware of the reality of student loans being sold to the private sector, and maybe even influence the committee's recommendations on the future sell offs. There's quite compelling evidence to the committee already that the business model for selling off the student loan book is unsustainable in the longer term, so this might just be our best chance to have a say and influence the decision makers... got to be worth a try!

The list of committee members is here, with individual contact details - might be an idea to bombard them via Twitter too?

Erudio received my deferment application last Tuesday and by the Saturday morning the DD was set up on my account - quite how they found the time to set it up when they're so busy processing the backlog of deferment applications, I don't know... just proves they're at it.

It all depends how you want to play the game with Erudio, if they take a payment under the DD, I have the guarantee to rely on and it's ultimately more damaging for Erudio's case when I take my complaint to the FOS. Others might not be willing to do that, so it's what each of us is comfortable with I suppose.

For those making a complaint, I was reading that it costs Erudio £550 per FOS case (the first 25 complaints are free unfortunately). It did say that if the complaint is dealt with informally, there's no charge, so if you want a little payback, make sure you jump through the hoops and put a formal complaint into Erudio, then complete the form on the FOS website when the time comes.

Have just spoken to Erudio about them taking a payment from me despite letters from both SLC and Erudio saying I'm in deferment until May 2015. I have been told by them today I am not in deferment and they haven't received an application for deferment from me; I haven't received anything from them to apply for one and as they've previously told me I am in deferment I didn't look out for one!
They are sending me a pack and expect all of it filled out and details of my joint bank account (with all details visible).
I have drafted a letter I'll be sending recorded today stating that I am in deferment and will not be filling out any more forms until next year and if they don't respond with a reason why they keep taking money I'll be speaking to the FOS (a formal complaint that will be charged to Erudio).
This whole thing is disgusting and would never have taken a loan that I thought would put me (and my partner, who I didn't even know at the time!) in this position.
The lady I spoke to at Erudio was a temp and can't wait to find another job! I don't like rowing with people I don't know but to tell me that I'm not in deferment when I have a letter from them in front of me saying I am is more than ridiculous and would make anyone a little exasperated. Now for the waiting game which isn't going to be easy I'm so mad!!

I have it on good authority that if you have a loan with thesis servicing and Erudio then the SLC will continue to process deferments for ALL loans.
In a way if your loan was sold off to thesis (aka link financial) you are one of the lucky ones as you only have to deal with the SLC!!!!

Well surprise surprise received a letter today saying I have not provided
enough information. I sent 3 bank statements and my p60. But no
they want confirmation of child benefit to. Even with this I am not earning
enough so why request it. Never had to provide it before it is only
child benefit that everyone is entitled to if you earn under 40k grr.

Just to let you know that they granted my deferral with bits blacked out from our joint account bank statements and my husband wrote on the copies that he does not give permission for his details to be shared with them. You clearly don't need all details visible - especially as it is none of their business as they are not dealing with him!

I just can't believe that you have TWO letters saying you are deferred! Actually going on previous evidence this thread, I can believe it of this company.

Good luck x
