@JeLaw.... Sad I know but don't let them get you down. Holes have appeared in their interpretation of what is acceptable when they have been challenged about certain points. It is now clear that this will be a lengthy battle. Hope you feeling better.
@Forever... Don't feel bad, we all have to take our own path when dealing with these heartless clowns. For what it's worth, I wouldn't offer them anything if they are going to mark your credit file... Something they don't have a right to do if you defer.
@Lungboy. I wouldn't personally bother to correct them at the moment. If you sent your complaint by registered mail it is easy enough to prove when you sent it. On top of that if you kept a copy of it, you will have the date at the top? They did this with me and I added it on my list of complaints when things were escalated down the track. The FOS (useless as they are) had no bother in upholding that Erudio did not respond in a timely manner.Paying for uni to get a job... just to get a job to pay for uni0 -

Aye, I sent it the 10th via email, and the 9th via recorded delivery, both of which I can prove. Useless sods.0 -

I have a 1996 contract, so they could report it to CRAs at any time. Although it's not lost on me that they haven't carried through with their threat of actually doing so yet.
I wonder if I did do a partial settlement, if this would go the same way in that they wouldn't actually do it?
I'm not sure what the Student Loans Company would do, but I have wondered if they wouldn't report it. Unfortunately, I doubt many people would have done a partial settlement with them, so I'll probably never know.0 -
I'm not sure what you did last year with their DAF but the original T&Cs even for the pre98 loans means it is dubious they can report loans in deferment. Several people on here have posted on this subject. They may threaten it but it remains to be seen if they will actually do it. They are relying on clause 16 which is too ambiguous. It does not show we gave informed consent and why I believe they want extra consent by insisting deferment is granted by using their DAF. It has not been tested in court partly because I'm sure Erudio would not be sure they could win and partly because they have coerced enough people to pay up with the illusion of what they may do if they dare to defer.
In terms of a settlement you have every right to negotiate with them. It hardly benefits either party by closing an account with a mark on a CRA. It may be a partial settlement but you are doing it to close the account once and for all. As I said earlier, we all have to take our own path in this but if I were eligible to defer then I would. If I were to settle it for £700 not only would I want written guarantees from them that they wouldn't record it on a CRA, I'd want them to destroy all records of me apart from one document that held the terms of the settlement... Anyway, I have been filling in their DAF, but I have been marking it as 'not accepting any changes to the original terms and conditions', along with my signature. Plus clause 16 is pretty ambiguous. So a court of law should accept complaints if they try anything on.0 -

It can be done but can also be a bit of a lottery depending on what info you supply on the DAF and which T&C you cross out\accept.

Good luck with that. I've been waiting two months for a response to my letter saying exactly the same thing. Yet, they've only just responded to a complaint I put in to the FOS two months ago about them claiming I had arrears on my account when I had just made the monthly payment. They claim there was arrears of £160 on my account which seems odd considering I've always been in deferment without lapse and the minute I'm over the threshold I make a payment - there's absolutely no room for any arrears to have been applied. Their letter says they've deleted it from the account like they are doing me a favour! They should never have been applied!!
In any case, they said if I'm not happy with their response I can call the number in the letter. Today another payment is due so guess what I'm going to be doing? Phoning this number and giving them one hell of an earache. They are willingly not responding to anything they have to respond to and delay it as much as possible hoping you'll either give up or cough up.0
