  • Do you know which T&C scored out on those applications which ESL refused to accept? Just curious as it helps to gauge what they consider the T&C to be or their interpretation of the original agreements.

    I had mine rejected for deleting part (e) of the Certificate and Warranty section:

    (e) I have read the information below about how the data collected within my application will be used by Erudio Student Loans and others.

    where the box below states that by proceeding you are "accepting that we may each use your information in this way." In other words you are giving permission to both Erudio and the CRA to use and share your personal data. This just isn't on.

    In the Erudio FAQ under 'Why do I need to sign the deferment form?" it states:

    A signature is required to verify the information provided and is not intended to provide any additional consent above the original terms and conditions.

    This seems to contradict their own DAF. When I sent my form in with part (e) deleted they sent a letter claiming the form was not signed and dated, which was false. When I telephoned, they told me I had not "agreed to the terms and conditions" of deferment.

    I am waiting to hear the outcome of my complaint but Erudio don't seem to know what they are doing.

    @ GinOClock I think when I saw "we may each use", I assumed they meant their extended group, so Arrow Global, CarVal, etc. But that makes sense that they mean the CRA, as they have a responsibility to make sure proper consent has been given and will also want to cover their own backs with the reporting.

    @ BorderReiver It's actually GinOClock's application that I knew about, the other was on the forum (Bungaloosh?) whose application was rejected for the same reason as GinOClock - not sure Bungaloosh mentioned the exact terms crossed out?
  • Thanks guys... I think they know what they are doing and are trying surreptitiously to gain extra consent should they be foolish enough to go ahead with CRA reporting. This in my mind points to a lack of confidence that they already have consent via our original agreements (which is a right they claim with the pre 98 loans with the FOS backing them on it). In short they want us to accept the way they want to use our information and that you have no choice about that if you wish to defer.

    Thank you very much. I've copied out the box from 'your' modified page and pasted over that of Erudio's. I presume I simply sign and date the original, upper, light grey box and your modified passage as well?

    It was Bungaroosh who mentioned being refused deferment, on page 214:
    As for this year, 1st June -- sent form with section 9(e) crossed out and the black box on the final page crossed out. I also omitted my date of birth from the front page.
    On 12th June I phoned them -- they said I needed to send page 1 with my date of birth on it.
    Then on 17th June I phoned them again and they said any amendments to page 6 ("Certificate and Warranty") would mean they would refuse deferment. So I had to send that in as well.
    So exactly the same as GinOClock. But I removed section 9d) and e) and the box below the declaration and added my own statements, and Erudio accepted that.

    my partner sent in a settlement letter in mid may and first payment was due to come out in late june. she hasnt had any correspondance from erudio and payment hasn't been taken either. she's not sure if she should contact them or not? any advice?

    Hi Tom, Yes that's what I did anyway. I did think about removing their boxes for signature and date and only signing the once at the bottom of the extra statement, but thought it might give them an excuse to refuse the DAF as the forms are probably scanned into their system. So kept their signature box but added my own and signed both.

    With a bit more info we may be able to offer better advice but the up shot of it all is you need to contact them.
    Has your partner kept a good paper trail? Did the correspondence go by registered mail? I only ask because Erudio may have lost your partner's letter or only partially acted on it. Did your partner have a direct debit set up?
    My advice would be to contact them by registered mail and find out what is going on. There are a couple of people on here who made moves to settle only for Erudio to stall and they have continued to take payments.

    It could be deliberate or plain incompetence on Erudio's part, either way they'll happily add arrears to your partner's account, even with a DD set up and/or evidence of the settlement letter you sent.

    I agree with BorderReiver's advice on contacting them to find out exactly where you stand, by letter/email so there's a paper trail. If you don't, the next you'll hear from them will probably be an arrears letter in a few months' time, they really are that useless.
