Hi Jenefina78, looks like they're stalling your application. They'll have your DOB already, you could easily confirm that without completing all of their crappy form again.

Is there any way to check previous court judgements? There's nothing comes up for Erudio in the Scottish Court Service's website, but that doesn't hold all judgements. Would it be worth an FOI request to the English and Scottish Court Service's, could check for HSL/Thesis too?
I guess that even if we knew there hadn't been any judgements, that doesn't mean Erudio can't or won't use the courts for genuine defaulters in future.
I may be barking up the wrong tree but a quick search reveals there is a register of judgments but there is a charge for searching it.

I am sure there will be nothing listed for Erudio simply because of the reasons I stated earlier... they will avoid court action with those of us actively engaged in challenging their interpretation of the agreements re use of DAF and CRA reporting. One court case that goes against their interpretation could spell disaster for their DAF lay out and CRA scare tactics.
I honestly think they were fobbing the FOS off in your case when they said they had plans to report loans later in the year. If they do report them they will only do so with those who have unwittingly used their DAF and offered extra consent (and ESL extra confidence).Paying for uni to get a job... just to get a job to pay for uni0 -
Has anyone had their DAF declined recently, because of scoring out the CRA stuff? There's a couple of applications where Erudio have declined deferment on that alone, whereas I completely rehashed the declaration and got deferred quickly. Either Erudio is being selective (loan value/income?) or they've changed their procedure/policy since I was deferred in May.

I think it's still early days and they are still finding their feet. I am sure that in time the more clear cut defaulters would be taken to court. I guess it comes down to what is cost effective for them and I'm sure they will carry out risk assessments. If they can make a good return on those poor souls who have fallen in to line then why risk a judgement in court that tests their DAF and CRA position?

I've got a question. I was told by the national debt advice line before I sent my settlement letter that I had to make it clear the money was available from a third party and therefore was a limited offer. This is still the case and I am using third party money to stop me going into arrears. It's been two months since they received that letter and they've done nothing. Another payment is due on the 10th so that will be a third payment they've got out of me since this started.
It seems bizarre to me that they've been given an offer and they've not acted on it. Any ideas?0 -
Perhaps the people holding the real reins are not sure whether they want to set precedents of accepting settlement offers just yet, so are dithering over yours?
