Well I've finally had written confirmation from FOS that they're going to contact Erudio to get their information about my complaint & then they can investiagte. FOS should be in touch within 12 weeks....
So if it only takes 12 weeks (& everything has taken a lot longer with them so far) by then I'll be 10 months in arrears - laughable.
Only I'm slowly losing my sense of humour about this :rotfl:And I find that looking back at you gives a better view, a better view...0 -
I lodged a complaint on the DAF with the FOS and they have upheld Erudio's position! On both that and Erudio not telling until 4 months in that they would only backdate by 3 months. So Im now 9 months in arrears, and liable for it. Thanks FOS!
It would seem fair that 'the clock be stopped' for such appeals, but I suppose this way dissuades dissent.
Anyway, Im appealing the decision and may write to my MP as well.0 -
FOS adjudicators do make some ludicrous decisions sometimes. You dont have to accept their decision and can refer to an ombudsman. Even the ombudsman's decision is only binding on the company not you, so if that goes against you you can still sue Erudio. AReeves the lawyer who posts on here can probably help.Still rolling rolling rolling......

You don't have to use their DAF to be deferred as a lawyer on here has successfully argued.
But can you then sue erudio for time wasting and harassment as they know this?

Was it a junior adjudicator at the FOS that sided with Erudio or was it the Big Kahuna ombudsman determination?
Who are you appealing to?
What were your grounds of complaint?
What were Erudio's arguments?
The success of FOS complaints depends a lot on how they are presented.
If you go here you can see that a lot of the time, the ombudsman is fair but sometimes people don't present their argument the right way and are not upheld:

Often the big kahuna may overrule the adjudicator if an argument is put forward with strong facts and evidence.0 -
Has anyone here obtained their credit file and found a search on it by Erudio?
I don't think it is fair for them to do that without consent.
Also, I know a few people have had deferment granted without using the form and many have used the form but crossed out the FPN, but has anyone managed to get confirmation that the FPN will not apply?

Erudio have already told me and others that agreement to the FPN is optional (both pre and post-98 agreements), I can PM you a copy of them stating that if it helps. Not quite sure how they worked that one out though, when the DAF states if you submit the form, you agree to credit searches, and worse, if they accept the deferment application, you agree to them registering your deferred loans with CRA's. None of that is in our loan agreements or the regulations. That can't possibly be seen (by sane people) as anything other than imposing new terms. I think they're trying to test all manners of !!!!!! stuff and hoping some of it legally sticks.0 -
