Reminder from earlier.Have to keep going on this.
A random thought summary on what to do if Erudio misbehave or do something you think is unfair or not right...
Please add anything you can think of or I might have missed this early in the morning before brain is properly caffeinated.
- Make a formal complaint putting Erudio on notice that you will be taking them to the Financial Ombudsman (FOS). http://www.financial-ombudsman.org.uk/consumer/complaints.htm
Take the complaint all the way to the FOS proper after Erudio give you a final response or after 8 weeks from your initial complaint. Whichever is sooner.
Don't let Erudio off the hook.
Before you get to that though, perhaps call the FOS on 0300 123 9 123 or 0800 023 4567 complaint.info@financial-ombudsman.org.uk as the FOS will often be willing to write at an early stage outlining your initial complaint to Erudio.
- FCA Rules - Perhaps familiarise yourself with at least section 7 CONC 7 of the FCA rules on how they shoudl behave collecting debts. Other parts such as post contract conduct and others in those rules may also be useful. All here. http://fshandbook.info/FS/html/FCA/CONC
Report any breaking of those rules in a formal complaint to [EMAIL="consumer.queries@fca.org.uk"]consumer.queries@fca.org.uk[/EMAIL]
FCA cannot do anything on your particular case, but they can log and look into complaints and use those to consider taking action (legal or regulatory or removal of licence etc), as they have shown so far this year with many of the dodgy payday and debt management firms. If the FCA don't have complaints against Erudio it is harder for them to act.
Breach of those FCA rules would also be highly useful to emphasise in any FOS complaint.
Unfair practice not technically breaking the rules should also be reported.
- Tell the media - If you have something you think MSE shoudl know and/or report on then email [EMAIL="news@moneysavingexpert.com"]news@moneysavingexpert.com[/EMAIL]
There are also other journalists who have shown an interest and/or published articles. Simon Read of the independent, Paul Lewis of BBC moneybox, Radio5, You and Yours on Radio 4 plus some others I'm sure.

I thought that if you have split loans, then all deferment applications are handled by SLC?

Has anyone with split loans been deferred in the normal manner,old style form automatically sent out by slc, after the last lot of loans were sold to erudio? Last year my loans were deferred by slc but that was just before the sale.Was trying earlier to find info about deferment on slc website and all I could find for mortgage style loans was phone numbers for erudio, honors and thesis. No mention of split loans.
Slightly off topic but what is normally sent as evidence of income when payslips are emailed as pdf's. Can I just print them myself or will I need to get printed payslips from employer?0 -
A twist in my Erudio tale... %*^$ers.... So, ombudsman found in my favour, arrears to be refunded, credit file to be cleared of any arrears markers, and £100 for distress.... Well, got a NOSIA today, seems they have went into my account back before my deferment was approved, and added the sum they are going to refund me onto my arrears at that point. So, I did owe £173 once deferred, but now it seems they have massaged the figures and decided I actually owed them £346 (after payment, leaving arrears of £173). They money they will be refunding is being taken out of my account and billed to me in made up arrears!
Has the combined effects of meaning I'll still be out of pocket if I pay the arrears even after my distress payment is taken into account, or, the account will still be in arrears, and they can mark my file as in arrears again as this is a different amount.
Realistically its seem they are giving me my payment back, and leaving the account in arrears, as if it was never received, not what I though I was agreeing to. I imagine they don't have an accounting process to do that simply hence the adding imaginary amounts to my arrears.
Back onto ombudsman tomorrow... Hopefully they way they've done it counts as accounting fraud or something really serious.0 -

It's serious harassment! Write to the FCA too even if you have already and explain that you have been messed about for months by these chancers!0 -
This letter has been suggested on other forums as there in nothing in the law or the loan agreements that says you have to use their forms. As long as you supply the proof of gross income that the law says is required for you to defer, can't see that they have any legal basis for refusing deferement. You would have met the legal conditions and given them proof.
Having looked through the deferment form, I'd like to know if this point should also be addressed in the letter?
"Keeping your Direct Debit details current (whether your account is in deferment or not) is a requirement of your credit agreement, and not doing so is a breach of this agreement...."
They then ask for your current account details and state "Sign and date the Direct Debit form or your deferment may be rejected."
I suppose what I'm asking is, are we legally obliged to give them this information as part of our deferment request?

Yes, they confirmed to me in writing that the DD was no longer a requirement during deferment, even apologised for insisting on it, but even though it's there in black and white, I simply don't trust them to honour it, at least not until it's official on their DAF, website, etc.
Here's hoping the revised DAF will resolve the DD issue once and for all.
This should answer the issue with the DD, plenty have not filled it in after they happily dug into accounts which they did not have any right to at the beginning of all this.0 -

I have a disabilty - autism/dyslexia. When my student loans were at the Student Loans Complany, I had special measures to help me to accesses services. When Erudio took over my student loans, I made a formal request for special measures. Erudio have simply ignored my request, and have applied charges to my loans. I am also one of the unlucky 500 who had money added to their loans unduly recently.
Erudio are acting like a shoddy back stret debt collector, and have harassed me constantly since I asked for special measures. I really feel like I am being targeted. I would like to pass my story to the national press. Any advise please would be welcome.0 -
