And thank you Helen for the article on these recent letters. IT all still sounds rather confusing why they would send out such a clarification letter, and not include a proper balance, as they must know that it will lead to confusion. Another example of Erudio doing as little as possible to carry out their duties, whilst at the same time leaving people questioning whether they should start repaying their loans or not. It is this questioning of whether to pay or not that has prolifertaed through every communication with Erudio. I never once thought i needed to repay SLC in the over 15 years i contacted them. The only reference to such a thing was the clearly stated was the 'if you earn over £XXX, then you need to start repaying your loan' (paraphrasing) statement. Erudio Inc. know full well what they are doing, and to me it is totally unacceptable. Incompetence only goes so far and for certain issues, but its official letters and communiques always cause confusion and have a sort of half answer that needs further clarification. The kind of middle ground created by lawyers and skilled debt collector based psychological methods/tricks to create just the right amount of confusion to get a certain percentage of people who wouldnt normal pay, to pay!0 -
I did ring them today and they assured me that I was not actually expected to pay anything, so thats a relief. I was a bit miffed though when the advisor started to give me a lecture about how next year, to avoid this happening again, I need to send in the appropriate documents on time! I did of course point out that I had in fact done so last year and that perhaps if they didn't repeatedly lose my documents, that might be a bit more helpful but hey ho, at least its sorted for now.0

That's exactly it, it's not incompetence, it's bully tactics to make those who have no need to pay, pay.
Couple of payments from those scared into needlessly paying and Wilmington/Arrow have doubled their money.

The adjudicator is useless they are unaware they should stop collections during a dispute. But she has written to them asking why the arrears letters were all sent at the same time. I'm going to have to dip into my savings to pay them if the ombasman does not request they be wiped. Legally they've got to keep sending the arrears letters, as that requirement of the Consumer Credit Act doesn't go away while there is an unresolved dispute regards deferment.
Collection activity under the meaning of FCA guidance would be taking it that step further into debt collector letters and calls and legal threats above and beyond the legal notices and warning required under the CCA.
Unfortunately the CCA does require the FCAs arrears notice leaflet, and some fairly stark warning wording in the statutory notices, so it's often hard to tell for the normal consumer where one sort of activity stops and the other starts.

If I'm not entitled to defer im happy to sorta payment plan. I'm acrually !!!!ed at alot of the things. Bit really don't see any other alternative. I'll be persueingbit with Anthony regarding the terms and conditions around benefits and discrimination towards single parents. They're out dated and as soon as universal credit is rolled out even more so. Don't getbme wrong I'm not saying disregard all my benefits. Just the part which is there specifically so I can go to work and my children stay in child care. It's hard enough being a parent single or otherwise than having to juggle my finances even more so to pay back a loan I feel I am being pushed into doing.
