  • I contacted old slc. They said erudio have all our info so SAR should be sent to them. Also if it is just cca wanting erudio should provide this without SAR request of if looking for past statements.

    I'm just trying to catch up on this thread. I've not had a chance to check in for a few days or so. I've got so many other things going on - so dealing with the continued Erudio saga is not ideal...

    I'm sorry I can't really answer your question about DD exactly but I share your concerns over this. As Erudio have a history of taking money from people's accounts (despite them being in deferment) I didn't I could not trust them with my DD details. I didn't provide them (although I never cancelled my original DD agreement and have the same bank account), added a note with my deferral that I understood this was not a requirement under the original terms and conditions, and was deferred. With no mention of DD in the letter from Erudio confirming deferment.

    Now I'm reading on here that Erudio are continuing to try to insist this is a condition of deferment. And I received my annual statement last week - and noticed they state having a DD set-up is a requirement.

    I'm concerned they will try to claim I am in breach of the agreement when I reach the time (not for a few years) my loans should be written off (unless, of course my earnings have increased by then).

    I can't believe this would constitute a breach that would allow them to refuse to write off my loans - as I still believe it is not a requirement in the original terms. But I suspect Erudio might try it on. And I will fight them on this.

    They haven't contacted me to ask for a DD to be set-up. As far as I'm concerned the onus is on them to do so - as I specifically referred to this with my deferment application. Should they disagree with my assertion that there is nothing in the original terms and conditions requiring us to have a DD set-up during deferment, they should contact me - with evidence to the contrary. I will fight them on this if I have to - although with so much else going on in my life at present - including health issues - I really would rather not have this to deal with as well!

    JeLaw - have you considered contacting Anthony Reeves re. the DD requirement? In case you haven't seen his posts, he is a lawyer with an interest in the Erudio situation - if you go to page 105 of this thread, post no. 13 on that page I believe, he issues an invitation for people to contact him informally - he may well have an opinion on the legality / enforceability of the DD 'rule'.
  • I don't know if anyone has asked this question before, but has anyone contacted David Willets MP about Erudio's antics? I realise he has now resigned as Universities minister. Quote -

    To be fair to Erudio they haven't told me that I've defaulted (but they haven't told me I haven't defaulted either). All they've sent is the NOSIA saying I'm 2/12 in arrears - which is true.

    However under the 1998 regs (Section 2 Part 1 reg 15) says "If the borrower does not make a repayment under the agreement when it is due, the lender may ask him to repay the loan in full immediately. The lender may do this even if the borrower’s obligation to make other repayments is currently deferred."

    So can Erudio say you've defaulted if you just miss one payment?

    This NOSIA doesn't specify a date to pay £x by, or even ask for payment. It just gives me information (which I can't read very well :mad:).

    My noddle (credit) report is due next week, so I'll report back if anything has changed.

    The £10 charge covers all of the personal and financial info Erudio has on you, which would include your original loan agreements (if Erudio have them!).

    Erudio must have had a lot of info from SLC as they told me my bank details & they knew I needed large print paperwork. When I phoned SLC they said they only dealt with income contingent loans & had no info on anyone who had mortgage style loans.

    I'll post my SAR tomorrow (signed for, naturally & followed up with an emailed copy :D).

    I now always put my full name, address, DOB & Erudio number on every email to Erudio & they've either replied fairly quickly (within 3-5 days) or ignored emails completely - none of this asking for even more info rubbish.

    Wish I could charge them an hourly rate for all the time I'm spending dealing with them - would have paid off quite aa chunk of my loan by now.
    And I find that looking back at you gives a better view, a better view...

    Jelaw. If you had a dd in place with student loan it will have been taken over by erudio automatically. Check with your bank. Els student loan. I had a letter saying this. I checked my bank. They took it over in march. This might be why they are not requesting a dd.

    But even if Erudio have had the details from SLC they still may not be able to use the d/d. They did get my d/d details from SLC but can't say why they are unable to use it, other that saying it isn't active (fine at the bank, just their end :wall:).

    So even if it does appear on your bank's d/d list don't assume that Erudio will collect on it.
    And I find that looking back at you gives a better view, a better view...

    But why do I get the feeling that none of the big boys (apologies to the male posters here, & not trying to offend, but I can't imagine there were many, if any, women were involved with these negotiations since that's how politics & big business works in the UK) will ever be told off/punished/sacked for their roles in it all :mad:
