    With Reference to Defaulting.

I may be being terribly naive but if you have sent off your evidence (recorded mail) of being under the threshold and Erudio dispute it/ignore it/lose it/say they need more etc then your DISPUTE starts with them at that date. Any arrears accrued due to their incompetence/gamesmanship will be void as when it goes to court/arbitration/ADR you will have proof of income/under threshold sent at that date.

I wonder how many have paid up out of fear? There is about 200k people affected apparently. Would anyone know the breakdown figures of say : Long term Defaulters V's long time deferrers? Seems these forums are filled with the law abiding citizen just trying to get these vultures of their backs?

Well I was going to be yet another one who made a payment out of fear today, but actually according to their website I've already defaulted as I've already missed the last two consecutive contractual payments. I have a handwritten note I made from my first call with them when I was told it was "miss 3 payments & your defaulted" but I didn't get that confirmed in writing from them.

When I phoned tonight the chap I spoke to initially said it was many months before they passed details to a 3rd party , then he said 6 or 12 months when asked to clarify many. I'm following up the 12 month quote asking for confirmation with an email to customer services (which they'll ignore until I ask the same question at least 3 times :rotfl:)

If I have defaulted I've not been told about it - possibly because I'm still in the 8 week timescale from them to reply to my official complaint. Seems like a big flaw in the system....

Pluthero - I agree that any arrears/defaults accumulated during the dispute shouldn't count, since I am under the threshold. But I don't want to rely on them treating me fairly....
And I find that looking back at you gives a better view, a better view...

Sorry if I'm covering old ground, but it's a long thread - what's the most up to date recommendations on submitting a deferral?

Is it to sign the 'new DAF', but delete/amend the parts that you don't agree to? (New T&Cs.)

Do the above, but also include a covering letter outlining refusal to provide certain information?

Not to complete the DAF, but write a letter refusing to supply anything over and above what the legislation demands?

    Or something else?

Quickest way to get deferred is to sign the DAF (ain't seen the new one if it does indeed exist) AND black out all terms you do not consent too; which is pretty much all of it! How this is materially different than using a cover letter I do not know but it seems to please Erudio which should be enough to make you VERY suspicious!

If you send a cover letter be prepared for a longGGGGggggggg rally of letter/email tennis. I wonder how much all this admin is costing Erudio?

This thread/debate really needs a STICKIED POSTto get more people complaining to the authorities. I will try to knock one up at the weekend.

That's my next move - was going to wait until the 8 weeks for my official complaint is up early in November, but may do it sooner.

My MP is a LibDem so was going to lead with angle that he may want to do something to redeem his party in the eyes of all students, past & present :D. Just in time for the election....

For clarification, in my professional opinion, there is no requirement to complete their DAF. All you need to produce is evidence of your income being below the threshold. In my mind, all this supposition about this, that and the other will go on longer than a soap opera; what we need is a court decision. I am getting very close to saying I will take on deserving cases on a pro-bono basis.

Thanks great news Anthony. I am just waiting on outcomes of complaints from the FOS and Erudio's final FINAL response before taking that step down the legal route. I have emailed you. Like most people I am loath to go to court due to costs/hassle/stress. I am sure there are many out there who would gladly donate something to your costs if Erudio got put in their place. This is turning into a very long saga for a great many people :(

There is a rumor that the admin is subsidised/paid for by the tax payer.

Now there is a good FOI request.

  • Hi,
I'm new to this site, but stumbled across it while searching for information about Erudio. I have loans taken out in the 90s, and to be honest, I deferred without much problem back in May. However, I've been asking Erudio since for a copy of my original credit agreement. No joy. They have acknowledged I asked for it, but never send it and don't seem to reply to emails at their customer services address.
I rang them tonight (first time in ages) and was politely told that a copy of my original credit agreement would be in the post in the next few days.
While on the phone, I queried the direct debit situation. I have a letter from Erudio that says I don't have to have an active Direct Debit in place while deferred. So I went ahead and cancelled it once I was deferred. But, having read this forum of late, I see there is confusion on this matter. The guy tonight told me, in no uncertain terms, I must have an active Direct Debit and other than say 'I see your point', couldn't help me and just said I should have one.
    I'm confused. Advice anyone? Cheers.

    @Jonez

Yes - believe it or not, I've had all of my loans with erudio cancelled...

    Some good news :T
Should darn well think they'd cancel the loans :rotfl:

Well, today I've had my NOI - not a mention of it when I spoke to Erudio on the phone last night.

Sadly I can't tell if the figures are correct as surprise, surprise they haven't managed to send it to me in large print, so I can't read all the figures even with a large magnifying glass :(

Like others though, I can tell that they've lumped all 3 loans into my first loan as one figure - which isn't right.

Does this sending of the NOI constitute a violation of the CCA rules regarding debt collection activity while my complaint is being investigated?
And I find that looking back at you gives a better view, a better view...
