    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    maybe its just me but I find it ridiculous that a small claim can result in barristers being present !

    so you get cases where there are no lawyers present , cases where its a "green" legal eagle jobbing around and yet tomorrow its a barrister that costs more than the claims being sought and proves the bullies are these large firms abusing the small claims court system whereas the average joe bloggs could not afford one nor would they employ one

    I agree. Parking Eye are using the court system as a form of aggressive debt collection. That's not the original intention of the Small Claims Court. You can see how cynical the whole operation is by the news today that PCM UK dropped out of a court case when somebody stood up to them. The reason they gave was "It's not worth the costs associated with them attending and business costs"

    So why they hell did they start the court case in the first place? Of course they were hoping the motorist would be scared by the thought of going to court and just cave in. Typical bully behaviour.

    If tomorrows participants are up for some appealing if they lose, this could be the straw that breaks the camels back.
    They don't need the judges permission to appeal if they have a valid point of case law to pursue which gets ignored as they often do in county court.

  • What you need to remember is that the ethos of the small claims court is fairness to all parties so bringing a barrister along could well backfire as the judge will deliberately intervene to balance the argument.

    Essentially, we've already seen the judges intervene, and tomorrow isn't the last of it as there are contempt of court hearings later in the year (June wasn't it?) where PE directors could actually be facing jail sentences. (Remember the toothbrush comment? That was telling the solicitor that if they didn't stop all the cases she'd be jailed for contempt. Judges have very wide sentencing powers over perjury and contempt, don't underestimate how much trouble PE are in in court). Google sword of truth...

    Without being unduly cynical, its reasonable to conclude that the reason barristers are involved may be connected to the fact that PE issued over 700,000 invoices in their last financial year.

    "Where there's muck there's brass" or is it "Where there's brass there's muck". Well, either way one or other of them.
