Hi - have had reply from POPLA saying:
"If the parking charge has been paid there can be no appeal because the operator will consider the matter closed.
I appreciate that you say about paying the charge. POPLA can only decide appeal between parties where there is an alleged liability for a parking charge in existence."
Worst part of this is feeling so naive about the people at PCM. Stupidly, never thought of them as clampers without clamps.
I feel that I should have known better and pre-empted the call to my Son. Sort of strips you of some of your dignity, and make you feel you're losing it. Can't blame my Son for being bullied, he is young, and will learn from this - but he has enough (they have enough !) on their plate right now.

Grandad, does your son own the vehicle in question or was he driving it when the ticket was issued?
The only reason I ask is because if he wasn't then he has no liability. I'm assuming the payment thing for POPLA is based around the fact that by paying you have admitted liability. It might be worth putting something in about what happened and that as you are the registered keeper you have not accepted liability and you have not given your son permission to accept liability on your behalf. I know POPLA don't accept mitigation in terms of the grounds of appeal but they do when it comes to the standing to appeal. Like when you appeal late, they will sometimes allow it of you have a good enough reason.
No - it is his car, and his wife (about to give birth and unable to get into her blocked space) was driving.

I would like to say that, as most PPC's read this forum they might feel bad about themselves, but I can't say that as I know they don't really care. Did your son pay on a credit or debit card? Has he contacted the card issuer to try and get the transaction cancelled?0 -
I wish to thank everybody so much for their time and effort on this post.
My Son and his lovely Wife need some peace and time right now - this whole upsetting incident has educated us much in this area - but they have to concentrate on this important stage in their lives right now and the stress has clearly created problems for them. I wish them all the best over the coming weeks.
While there are decent folk out there (here) to balance the likes of PCM, there is hope.

Ask the BPA to investigate this bullying and BP breach - and to confirm that the POPLA code can indeed be used as planned.

I still would suggest that you dial 101 and chat with the police. This was not a criminal matter, they demanded money with menace, misrepresenting the legal position. Harassment, fraud and demanding money with menaces.
However, understand that personal circumstances may make it not appropriate to pursue.0 -

We have actually thought about this - anybody have verification of this being feasible?0 -
yes - we are still here everybody - and now ( having taken in a football match together to unwind) are united Father and Son, to want to fight where possible. Which? have also been incredibly helpful and very interested.
We feel that something has to be done to stop these people dealing like this without redress.
Not sure quite where we're going..... but bring it on.
(Still having more than half an eye on the delicate emotional and health issues going on though)

Simply explain your circumstances, they will either agree that it is a problem and take action, or they will tell you that they won't act. What they will not do is be cross with you for getting in touch. They are the ones to advise you in the first instance.0
