PCM Aggression

Hi - new member and still in an absolute daze after aggressive phone call(s) from PCM.

Having told them that we were going to POPLA on appeal (and still well within 14 day appeal time) - a guy from PCM called my son and bullied him into paying on the basis that if he didn't pay right then, he would take him to court "and take him for far more"!

The appeal has a very strong case, but can he still appeal now that this money has been taken. He is in a very 'vulnerable emotional situation' at this precise moment which PCM are fully aware of which is why I have been handling calls for him. I was not aware that he was going to call my Son immediately after speaking to me, otherwise I would have advised him not to take the call.
These people are unbelievable and I have been so naive in thinking that there is somebody normal at their office who is reasonable.

Wish I had checked here first.

    I would try and get this payment reversed, go to the bank and tell them the situation, if your son is a vulnerable person then he should be covered under the Equality Act 2012 if it's a long term thing.

    The question I got to ask though is why are you dealing with these over the phone ? You never deal with this on the phone! Did you appeal to the parking company ? Did they reject an appeal? Is this England or Wales ?

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Did your son pay by card over the phone? If he did I would say the first step is to contact the card issuer and try and get the payment reversed as it was made under duress. I'm sure others who know about these things will help with complaining to the BPA etc.
  • I would also ring 101 and explain the situation to the police. This sounds like harassment which is now a crimnal offence.
  • You wont be able to appeal to Popla.
    Thats how the likes of PCM operate , thugs with laptops. Your popla appeal would have failed if as i suspect it wasnt on legal grounds alone.

    Personally i dont rate your chances of getting the money back from the card issuer, however it wont cost you anything to try,

    If it fails then you should mark this as an expensive lesson in how not to deal with companies like this

    Hi - Thanks for reply ( and all the others).

    This is England.

    On legal grounds - am very very confident that appeal with POPLA would be successful - actual facts (not mitigating circumstances although they are HUGE also)

    Did appeal - but but PCM just blank refused - but grounds for appeal are solid.

    Son is not 'vulnerable person' as such but PCM are aware of his current emotional situation which has a massive bearing. It seems now to be quite clear that they knew it was likely to be overturned by POPLA and needed to get in quick.

    In other words whos car park was it?
    where was/is the car park?

    pcm are almost certainly nothing more than agents acting for and on behalf of the car park owner.
    From the Plain Language Commission:

    This sounds like a most unpleasant experience for you and your son. Can I just home in on some of the facts we haven't yet had.

    Can you provide something of a time line together with whether this was a windscreen ticket or simply arrived through the post. For example how long after the event (or windscreen ticket issue) did the first letter arrive?

    Had a written (whether by email or letter) appeal actually been made to PCM? If so, what was the result?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(
