That is then a breach as they are classing this as an ANPR ticket and is late. But in reality this is a ticket on car, and they must not ask for RK details until days 29-56 after ticketing. This is a serious breach of the code of practice and I request you make complaints to the bpa and dvla. Copy in all correspondence to them.
Do you know if there are ANPR cameras there?

I don't think there are ANPR cameras because it seems for that particular car park they rely on men paroling either on foot or motor bikes.
Do I still print the appeal letter and send it to NPE or do I go straight to BPA and DVLA?0 -
You make the complaints to the dvla and bpa, don't admit to being the driver, only state that you are the registered keeper. If you can provide some images of the entrance / exit showing no ANPR cameras then they are in serious trouble. Not only breaching the bpa CoP but actually contravening the protection of freedoms act 2012 as well.

When you complain to the BPA/DVLA make sure you don't say "I was driving". You are the registered keeper and "the driver" is always used instead of I when referring to the actual offence.
Tell both the BPA/DVLA that a NtK sent within 2-0 days fails both of the 2 timescales quoted in the Protection of Freedom Act 2012 sections 8 & 9 http://www.legislation.gov.uk/ukpga/2012/9/schedule/4/enacted
I know legal docs can be daunting, but just use the words I wrote above in reference to the POFA.
When you do your appeal to the PPC, make sure that you say that, as they have failed to follow the timescales specified in POFA by sending the NtK after 20 days , this relieves you of keeper liability and you are, therefore, not prepared to provide the driver's name and are appealing as keeper. Cancel the charge or send a POPLA code.
Please add that you are being aided by a forum and that it may be prudent for them to cancel the ticket in order to save themselves the POPLA fee.0 -
NPE now have electronic access (as of last Friday in Feb) so have no reason for being slow any more.
As a result NPE are now riding around on motorbikes taking photos and serving the tickets by post as opposed to putting the tickets on vehicles. This effectively hurries up the process as it removes 14 days from the timescale.
Im assuming this is at Earlham Shopping precinct in which case the retailer does not own the land and the landlord Hackwood Homes doesnt give a hoot either way.Hi, we’ve had to remove your signature. Yes of course. That's the most basic thing to do or you could miss the appeal deadline! Why don't you just read some other threads on the first few pages here to learn what to expect in reply. Otherwise I can see you posting back here in 3 weeks time saying they've asked who the driver was and do you have to tell them? While I'm preparing a formal appeal to send to them tomorrow, which they will have to stop any further demand of payment or increasing charge according to their own BPA code of practice, I was doing some further reading, various sources say PPCs can only request RK info if 1.after 28 days if a "ticket" was issued or; 2.within 14 days if spotted by ANPR. So I guess I'm in scenario 2. I will try find evidences of them not installing ANPR. In the meantime, is there anyway I can find when my data was accessed to I can bring this matter to DVLA?0 -
You'd have to email the DVLA to ask when and by whom your data was accessed...and make it clear you are asking as part of a complaint, and are not expecting to pay for info because it's a complaint about a PPC and your own vehicle. The reason I say make it clear, is that the DVLA often reply 'fill this form in and pay us an admin fee' which isn't what you mean.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My thought might be that the patrol people are evidence gathers and report the matter to the PPC, rather than issue a Notice to Driver, I guess this is less confrontational, just a guy with a notebook and a digital camera/camera phone. This would mean that the letter is a NtK and should therefore be within 14 days. Did you read the post in the Lidl thread about managers being able to report violations (in relation to disabled bays) to ParkingEye who would then issue a NtK? In his original post the OP mentioned pictures from a digital camera rather than a ANPR camera.0 -
From PPC guys information it sounds like they have decided on a new way of operating but have not trained up either the patrolmen or the in-house staff or both.
They are therefore issuing tickets which are neither compliant with notice to driver or notice to keeper rules and are making a complete pigs ear.
Complain to the BPA and the DVLA. Hopefully can apply a training boot up the a*** and explain what they actually need to do.

Dear BPA/DVLA,
I wish to formally complain about NPE. Following their recent upgrade to electronic access their patrolmen are declining to issue windscreen tickets and are instead collecting information and sending back to HQ where they are issuing notices to keeper. However, they are not complying with the requirements of POFA 2012 regarding timescales. See my attached NtK. Please educate them as the requirements of the act and point out that it would save us all a great deal of bother if they cancelled all tickets, including mine, where they have incorrectly stated keeper liability applies.Dedicated to driving up standards in parking0
