NPE trying to get money out of me.

I almost pay this private company £60, what already seem like an extortion. However, after seeing they even charge £2.5 for paying in there own website, I decided they are really scandalous so would like to give it a try here and get some advice.

I was in this shopping place to get this large furniture, because I was in a van and you know how small their spaces are, so I park in the space in front of the shop which is large enough but a disabled parking space. The pick-up date was pre-arranged so it was going to be quick, but I wasn't told there's loading space at the other side of shops hence parked in the front.

I went in and came out with the furniture in what must been less than 3 minutes, and see this guy just starting to take picture, who must have been riding around the neighborhood to try to catch people, and told me the notice will be sent by post in 28 days, which it did.

What I really unhappy about:
1. there is no notice or indication of a loading bay in this facility;
2. Other spaces are not large enough;
3. I'm a shopper;
4. I was there in such a short amount of time, which seemed quite excessive to charge me, but given the nature of their business, they sure see this as an opportunity.

I'm sure if I appeal to NPE, they will reject, claiming it's for disabled only and so on, that's how they make momney. So, if I'm to appeal to POPLA, will they reject base on the same reason too?

    popla always reject on mitigation and on the EA 2010 as well for some strange reason

    this is why popla appeals rely on tested appeal points, like not a gpeol, no contract and poor signage etc

    Please read the Newbies sticky thread. The first step is to appeal to the parking company. Then appeal to POPLA, if you follow the advice and templates in the sticky thread you will win at POPLA.

    There are a couple of questions that could impact the advice you're given:
    1) Were you sent a Notice to Keeper (i.e. a letter through the post) or was the ticket stuck to the car?
    2) Are you the registered keeper of the car?
    3) Is Earlham House in England, Wales, Scotland or Northern Ireland?

    Well first make complaints to the retailer, say that you have spent a lot of money with them, and you will be bringing back the furniture if they don't get this cancelled.

    Second wait until you get the notice to keeper, if you are not the registered keeper then you need to make an appeal now, otherwise wait until days 29 - 56 after ticketing. The appeal you use is in coupon mad's sticky thread post #1.

    Thirdly if it's rejected we help you go to popla, we win 100% of the time with forum assisted appeals.

    Read the NEWBIES sticky thread at the top of this forum

    All the information you need to draft your appeal to the Parking company is there.

    Your precise circumstances don't really matter as much as the legal arguments that you need to include in your appeal. There are template appeals to help you.

    So read the thread again - draft your 1st appeal to the parking company and post it on here before you send it so people can help you refine it.

    The thread also contains all the info you need to draft a winning appeal to POPLA when/if the Parking Company refuse to cancel

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    1) yes I was sent the notice 20 days after the so called contravention, no ticket, the guy just took a couple of pictures. He only had time to take 2 because I was already there.

    the postal PCN should have arrived in 14 days so is not POFA 2012 compliant meaning the keeper is not liable

    That is then a breach as they are classing this as an ANPR ticket and is late. But in reality this is a ticket on car, and they must not ask for RK details until days 29-56 after ticketing. This is a serious breach of the code of practice and I request you make complaints to the bpa and dvla. Copy in all correspondence to them.

    That's really handy. The notice from NPE claim they only accept appeal in writing, so I print this off, "signature" then send it off? Should I use recorded postage?

    Also, do I wait for their reply then appeal to POPLA or do I go to POPLA simultaneously?

    do not send recorded, obtain free certificate of posting at the P.O.

    You cannot go to popla without a POPLA code from the PPC themselves , so no code = no popla (so you await their reply)
