    Hi,
    I've just emailed SteveC outlining the situation (with references), and mentioning the lack of acknowledgement by PE of my email to them. I had a response from POPLA this afternoon to my previous email (as mentioned in a previous post) but they just said they only deal with appeals, and I should contact PE - ooops, just had the email to Steve C bounced back! I used the link Ampersand gave above - is there an error?

If you cannot or will not ensure this, who can or will? Presumably you will apply sanctions to any member failing to deliver on ths undertaking'

    Ta, ampersand. I'll see what response I get from Steve C and have made a note of your suggestion! Am about to try ringing the manageresss, if I can find the shop number, otherwise looks like a little shopping trip! :-) Checked emails this morning, nothing so far from Steve or from PE in response to my email to them. Will let you all know what happens.

    Me again. First of all, please allow me to let off some steam - AAARGH! GRRRR! Why can't people COMMUNICATE!!!!??? Phew, that's better. Just rang the store and spoke to the real manager (it seems last week I spoke to "one of our two leaders" so presumably she was standing in for the manager). Anyway, I outlined the situation to him and he said, "they won't send a letter, they don't send letters, in my experience. If they haven't sent you a reminder then it's been cancelled - they don't send letters as it's a waste of money". So one the one hand I'm very relieved, but on the other hand pretty mad with someone - anyone - for the wasted emails, the broken sleep, and the waiting for the post every day. Waste of money, my foot! They're happy enough to waste money sending out their rotten demands. So you can see why I needed to let off steam. It looks as though it's been cancelled (but do they in fact send letters confirming cancellations? should I rejoice or is it too soon?), but I still feel I'm waiting for the other shoe to drop. Now for a cuppa - too early for anything stronger! Pity...

I am now fully aware of many public witness and court transcripts online. I must insist YOU insist that I receive a formal copy of this rescindment. My costs in pursuing this so far are blah plus my time @£18 per hour. You will note this is a correctly detailed, accurate invoice, unlike the pe document.'

    Ta, ampersand - I really like the "life is fine" quote. Sadly, I can't afford le bon vin in the UK, but luckily I shall be out of the UK soon, and making up for lost time! I'll contact Steve C about this lack of letter, which I think is disgraceful, though I do feel more celebratory now. I don't book of face, nor do I tweet, except possibly after the grape... oh,no, that's hiccups.

    ...and £18 per hour is the Court accepted rate[I, too, bring bouteilles back].

    Remember that pps in the bpa DO have 'points applied to Licence' -must not exceed 12 p.a. That's why it's important to pursue them to extinction.

    Thanks for your update and it's good to hear that your conversation with the manager of the store has helped reassure you.
    Personally I think you still need to have written confirmation from P E that this charge has been cancelled. Why? Because they have 6 years to possibly issue proceedings. Should they ever rear their ugly head again, having witnesses will of course be useful but staff and businesses themselves move on. I also think that you personally need to see it in writing to be able to put this aside and rest easy knowing it is closed once and for all.

    P E can and do issue written cancellations - mine came not through the post but via the email address I'd given when I appealed.
    People in other threads I've seen have received written notice of cancellation but have often had to be persistent before finally getting it.

    Time to bring out the big guns I feel and you have a big ace up your sleeve that hasn't been played yet - namely the landowner which you very cleverly discovered. You have 4 main lines of attack
    1/ P E themselves
    2/ The Head office/customer services of the retailer
    3/ The landowner
    4/ keep rattling the BPA's cage every couple of days as Ampersand suggested - remember the squeakiest wheel gets the most oil! :D

    I have to pop out for a while now but will be back on with some suggested approaches for you later.

    Thanks to Ampersand and ColliesCarer, two aces. This evening I had an email from Steve C, a really nice personal email saying that he understands a letter is on its way to me. Considering I hadn't actually asked him to do anything, only asked what I should do next, I really appreciate his chasing this up, as he must have done. So I'll let you know when it arrives. You're both quite right, this waiting for something that may or may not come is awful. Ampersand, I didn't understand the ref to pps in the bpa, sorry. Hopefully it won't apply to me now, whatever it is, but someone else might need to know!
