    The problem is that you could have the same in the future. Personally I wouldn't be happy to accept that as a final position.

    By simply paying these invoices they are taking away your right to appeal to the Parking Operator and POPLA. I see they are still insisting that this invoice is a "fine" and is covered in their terms and conditions.
    I think another email should be sent to them.

    Send them a link to the BVRLA 'contact us' page and suggest they might like to get up to speed with the MOU the BVRLA made with the BPA, seeing as they appear to have missed the information from January. And a PPC is not 'an authority' on anything. And it's not a fine at all. And Smart Parking are one of several PPCs who DO NOT INVOKE KEEPER LIABILITY (their NTO letters do not mention POFA) SO THE KEEPER NEVER HAD ANY BUSINESS TO PAY IT.

    Them paying a charge which was ONLY for the driver (and I mean ONLY for the driver because it wasn't a 'POFA' NTO, was it, as Smart don't do them!) is like them paying your paper bill and expecting you to refund them!
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    The fines manager is assuming a lot in this statement isn't he?
    "We appreciate that you are disputing the validity of the fine based on the fact that this was levied by a private parking company, however Smart Parking are a registered operator with the BPA (British Parking Association) and will have been acting on behalf of the landowner. Upon entering the car park there will be signage which will set out the conditions of which the driver is authorised to park, be that by payment of the appropriate paid parking tariff or by parking within a limited stay period or similar, and that a Parking Charge will be payable, if the conditions are not met."
    I think he needs educating into the world of the PPCs.

    Yet again somebody who appears to think that the BPA is some sort of regulator:-

    With hire/lease/rental companies showing hat level of understanding, it wouldn't take much to set up as a private parking company, stake out a car thats often used by fleet/hire cars issue PCNs for some minor this that or the other to the fleet manager/hire company and then rake it in.
    From the Plain Language Commission:

    "The BPA has surely become one of the most socially dangerous organisations in the UK"
