    but, there's many many more like me who would agree....no-one is 'more important'..or doing a 'more important' job , or whatever, than anyone else.

    The issue is..if one's livelihood depends entirely on driving, or having a licence in good order..then that individual should be taking extra care not to jeopardise the integrity of that licence...

    no excuses.
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    right, to make it clear, I understand its stupid and lesson learned.. I was born in a country that traffic police even today are a misery to deal with and like to stop drivers to get some money from them, so when I got stopped , fully cooperative with a very polite motorbike officer
    having riden bikes for 15 years , even more respectful towards them
    Question was if there is a case , to get away from it as never used phone on my hand to call ..and being on a high up position sitting on a van , for 1 mile I can find about 10 people still holding phone on their ear with the right hand ...don't know, maybe it was my day that day;) licence surrended and 100 quid paid ..

    To clarify, the Construction and Use regulations prohibit the use of:
    (a) a hand-held mobile telephone; or
    (b) a hand-held device of a kind specified in paragraph (4).

    (4) A device referred to in paragraphs (1)(b), (2)(b) and (3)(b) is a device, other than a two-way radio, which performs an interactive communication function by transmitting and receiving data.

    Further clarification is given in paragraph 6:
    (6) For the purposes of this regulation—
    (a) a mobile telephone or other device is to be treated as hand-held if it is, or must be, held at some point during the course of making or receiving a call or performing any other interactive communication function;
    ...
    (c) “interactive communication function” includes the following:
    (i) sending or receiving oral or written messages;
    (ii) sending or receiving facsimile documents;
    (iii) sending or receiving still or moving images; and
    (iv) providing access to the internet;

    i don't understnd why people don't pay 100% attention to their driving, if you have a serious accident , you wouldn't want the surgeon sorting you out to be checking their facebook status whilst they were waving a scapel about in your body or taking a selfie or twittering # putting another idiot back together again

    I watched as he went over the car (a 1996 Vw polo) with a fine toothed comb

    What has car and age of car got to do with anything?

    Are you one of these keeping up with the Jones type that think anyone who owns a car over 5 years old is a nobody?

    Engine off makes no difference, you are still in charge or a motor vehicle so can still be guilty of the offence. There are some caveats to that obviously, such as being stationary in a lay-by or car park etc, but if you were just queued in traffic then yes you would still have committed the offence. Much in the same way that you can be drunk in charge of a motor vehicle with the engine off. In terms of phone, someone supervising a learner driver is also committing an offence if they use their mobile phone as they are in charge.

    There is no such offence as using a phone whilst in charge of a car. The offence is using a mobile phone whilst driving a car - and driving includes when a vehicle is stopped at traffic lights or during a traffic hold-up.
