So if you can find any name without touching your phone how come you were caught using it with your hands? I think I've missed something?

You have, it was a postcode he was searching for.

the law was designed for a catchall all clause so it will prevent a "your word against his" scenario.

What is the difference between typing in your satnav and typing in your phone? nothing.

I've typed postcodes into my satnav while coasting in traffic at 5mph in front of police vehicles and nothings happened.

just pick up your phone to check the time.. bang £100 fine.

The stupidest implementation of this is that you cant read messages on your phone when you're stuck in traffic. Bone idle in traffic that is. They expect you to turn off your engine to do anythin on the phone.

Sort of, using a mobile is stupid, exceeding the speed limit is stupid as are all sorts of other motoring offences. All are dangerous and should be condemned but who is entirely innocent?
Doing the crime with a police vehicle on your tail however is more than stupid.

Exactly. Doing these things might be safe, but I've you've done it whilst not noticing the camera or police vehicle in front of / behind you, then it's pretty conclusive that you weren't paying enough attention to the road. I mean it's not as if they hide most of the time. It's why I don't understand how anyone can be caught by a GATSO.

Every car I've driven / owned since the early 80's has had a factory-fitted clock. My current one has two! I also have a wrist watch, so would never have need to use a mobile phone whilst driving just to check the time.

its a force of habit. we always check our phones when we have nothing to do whether it be staning on thetrain platform, in the lift for long period of time, at a queue at a supermartket etc.

    I dont.

It annoys me in traffic when the line starts moving bar the car in front of me because the person is replying to that oh so important text message...

If someone really needs to get a hold of me they would call me, and it will come through my car's bluetooth.

What Offense was the FPN actually for, there are two offenses that can cover mobile phone use, Using a mobile phone whilst driving has a very slim chance of being defendable at court as Jimmy Carr sucessfully proved when he argued he was using the phone as a dictaphone not as a communication device but you would have to take it to court and convice them that you were not using it as a phone.
The other offense some forces now use (to get over the above) is not being in proper control of the vehicle (the offence that makes headlines occasionally when someone gets done for eating or drinking whilst driving). If you have been charged with this then there is no defense.

Might be worth popping over to PePiPoo.com and see what they think over there

Cool, I will turn off my engine next time. :rotfl:

Joking aside I've never held up traffic, always keep one eye on the road. never check messages when I'm in the front of ther queue in traffic as that is easier to miss.

I might be breaking the law, but I have a busy schedule and I receive important info by text. I sometimes have to deliver equipment to clients and they all seem to send a text message rather than call to ask how long I'll be. That's frustrating.

Despite being only 29 I can remember life before we all had mobiles and do wonder how on earth we ever lived life without them!

Touching my phone when behind the wheel is strictly something i refrain from doing...
