Staff got a parking ticket

Hi, I currently work at Bradford Royal Infirmary, West Yorkshire.
I live on site but will not be issued a staff parking permit as there is currently >220 people ahead of me.
So, I rang the Parking manager and told I can get temp pass to cover evenings and weekends. But I would have to move the car off site between 8am till 5pm. Or I could park on site in the patients car park for a fee of £5 per day. However, he did say I could get a ticket doing this!!!!

I got 2 parking tickets for being parked on site.

Do I actually have any legal grounds not to pay or I am actually in the wrong as I don't have a permit to park?

Thanks for any info. Sorry if this one has been done before.

    Hi there

Who gave you the tickets ? Was it tickets on the car ? Have you had a notice to keeper twice, if so what date was it?

    Thanks

  • Thank you for getting back to me. No, I only got the ticket in the last few days and it was on the windscreen. I have not received any formal paperwork. To make this interesting I'm leaving the job on the 28th of March.

Okay which company gave you the tickets? This is important so we can tailor advice. Have you read the sticky thread by coupon at the top of the forum?

  • No I was unware of the £5 parking I only found out about that today.
I have read sticky thread. But, I'm unaware as to weather I am in the wrong. You do need a staff permit to park by the accommodation block. And I don't have one. The trust itself deals with all this.

    Let's say jobs worth.

It's unlikely they deal with this, who are appeals and payments to?

Oh dear they have seriously got things wrong on their site, they cannot issue penalties or fine you
    Fixed Penalty Notices
A fixed penalty charge is levied for any vehicle, not adhering to the Parking Regulations as displayed on the notice boards in the parking areas. The initial fine is £15.00 for prompt payment rising as non-payment continues.

  • You can pay £15 within 7 days. The usual thing.
And it goes up to £60 after 28 days.

You pay the money directly to the trust. But if you don't pay it goes to a third party organisation, who will then contact the DVLA and then take things further.

The appeal goes to the Assistant General Manager (security)!!

Sorry to be thick, but what does that quote mean?

It means that they admit its a penalty, which is actually unlawful as only the council or police can issue them mostly or if it's a byelaw ticket. It's up to you how you deal with this, but the only way they can force you to pay is through the courts. Do you want this?

The loss is £5 each, I would initially offer this to them as part of an appeal. Reminding them that anything more is more than the loss so an unlawful penalty. If you don't want the hassle pay the £30 and be done with it.

The problem we've got is that they are your employer, we don't know what kind of policy they have in your contract of employment, and we don't know what the nhs trust might do. They are not in the bpa so they do not have to abide by anything really. So it's up to you

Good advice imo. Just one thing - as you say the NHS trust won't be in the BPA but

    - will that "third party" be a member of an AOS?
