    I didn't send anything anything like that to my partner. The emails to him were general talk.

    The other material was never sent to anyone else other than myself, so l don't see how anyone else is or was at risk. It was through naivety on my part and l hope l get a warning as its something that can be rectified in the sense that no harm has come to anyone.

    I really do feel your clutching at straws here - for example my OH's Dad was fired for gambling on a website (basically did a few horse bets on his break)

    It does no harm to the company - but it's the same if he was looking at !!!!!!. It does no harm to no one - but that doesn't mean your not looking at getting sacked.

    Theirs loads of stuff you know your not supposed to do - but does no harm to anyone....

    Admittedly if this was me I would of laughed it off - but if it had been my best friend she would of got you out the door asap because she's not as broad minded as me & would think it was disgusting...as you were given a two week suspension pending investigation...I would be taking this seriously.

    True, yes, l am taking it seriously and hope that my previously unblemished record is taken into consideration.

    Perhaps it depends on the employer but I'd like to think that previous character and work ethic etc if unblemished, and remorse shown will and should be taken into be taken into consideration.

    K - You are entitled to your opinion.

    Were the facts and circumstances re your OH's dad's dismissal exactly the same as the OP's ? Did your OH's dad take employer to Employment Tribunal for unfair dismissal. If not, why not ?

    River Star's employer may summarily dismiss our member. For the employer that may be the easy part. Justifying such a harsh decision in front of an Employment Judge. Now that may well be another matter all together.

    If I were advising the OP's employer, albeit based on the somewhat one sided facts presented to us, I would tell them to tread very carefully and issue a written warning. If not, the employer (unless insured) may face a potentially large legal bill, and worse still may ultimately have to pay substantial compensation to the OP and face media scrutiny. This case cries out for compromise. Will it happen; who knows ?

    Would definitely start to look for another job and hopefully be able to resign before meeting.

    I don't know if this is comparable but someone at my last work used their work email to register at a dodgy website, although did not visit the site at work. He was dismissed. Certain words in your work email are picked up by security so I think they are on the lookout for that kind of thing

    I've began applying for other jobs, just in case.
    I really don't want to resign as l do like where l work, and also how woild l explain resigning on cv or at interviews?
    I am the only one that performs my job role there, am knowlege about day to day running of things and l am very good at what l do.

    However, l'm aware that this may or may not go in my favour.

    Again, employers , although many think they are, are not employment judges. They cannot decide what is fair. Did your friend take their employer to an employment tribunal . If so, what was the outcome ?

    Only a small fact , but any sending out of emails by OP to their pvt email addy was done when on unpaid break. Some 50% of UK employees do this. If they were all dismissed the economy would collapse. The email wording , if prima facie obscene, may well have triggered IT detection software, and raise concerns that any publication thereof could damage company reputation via misuse of company property. In this instance the material was apparently not published. May be hard for employer to justify summary dismissal.
