No they haven't, just looks like a standard fob off letter to me. Would I be better referring it to the ICO or financial ombudsman or are they the same thing sorry for my ignorance.

When did you complain? they have 8 weeks to get you their final response. If they give you their final answer before this, or the 8 weeks elapses, you can refer to FOS.
you could write and ask if this is their final response and if it is tell them you are referring to FOS.:beer:0 -
I raised the complaint around 3 weeks ago, I may write back reiterating the complaint and expressing that they are going against ICO guidelines and disadvantaging me compared to someone who paid nothing and was defaulted straight away, this should prompt a final reply.
Thanks for the advice.0 -
be sure to mention you intend to refer it to the FOS if required. It costs them £500+ per case referred, not that it seems to make them avoid it.:beer:0

Why?
So the customer comes into an arrangement to pay (AP) and Barclaycard record it correctly
I bet you'd say that you were good customers.0 -
They should either default to start with or not at all.
They are well known for it have been known to mark APs for many years until the debts repaid, then mark as a default.
This goes against the ICO guidelines of not putting someone in a worse position than someone who makes no attemp to pay, gets defaulted and after 6 years there is no record of the default.
Quite often you are not told they will mark as AP.:beer:0 -
