    I'd definitely escalate it to the FOS then. At the end of the day by committing to pay a nominal amount rather than a default means in our cases we did try to meet the repayments (even if it was lower than the requested amount per month.)

    Capital One have finally removed the account from my Experian and Equifax reports after initially complaining in March 2014; today I was accepted for a Lloyds Choice MasterCard/American Express.

    What an amazing thread! I've been on a DMP since 2006 (still repaying) and I was really worrying that my credit reference file basically had 7 years worth of arrangement to pay markers on it from Barclaycard that would probably be on there for another 9 years by the time all is repaid.


    I sent them a secure email last night based on the template letter on page one, stating that I thought it was unfair and had put me in a worse position than if I had defaulted and today I received a phone call from them. The lady I spoke to was very helpful and agreed that yes, whilst it was actually a true reflection of what had happened with my account, it would put me in a worse position than if they had defaulted me.


    She wouldn't agree to put a retrospective default on my account but did agree just to completely remove and reference to Barclaycard with all of the CRAs. This was on the condition that I continue to repay - if I miss a payment its right back on there.


    So, overall, good result. I know the proof is in the pudding and I won't be entirely happy until I get a copy of my files and see it removed, but so far, so good. I can even to some point understand why they wouldn't issue a retrospective default; they know by removing it I am benefiting but ultimately if I stop paying them, they can put it back and send my credit rating back to the stone age. If they retrospectively defaulted it, they couldn't do that. So I get what I want and they make sure they still have something to hold over me in case I decide not to pay!


    Either way, thank you for posting this! I only have to tackle MBNA/Moorgate now! Has anyone had any success with them?

    I have 3 ap markers from barclays and have also sent them letters asking for them to be changed to a retrospective default, but without any joy. What they have done for you sounds good, can you give me the number you called and maybe the name of the person you spoke to as i would like to try this approach?

    Will they put this in writing?

    I would refer this to the FOS to get it defaulted and gone.

    Yes, you're right - it may well come back to bite in the future.


    The lady I spoke to basically said she was only removing it as I had never missed a payment under my DMP - I think the difference with mine was that there were six years worth of AP markers and with another 3 or 4 years to go, that would have stuck with me for another 10 years at least. This was a long term issue. Had it been a couple of markers I probably wouldn't have bothered.


    I can understand their position - I get the AP markers removed so I'm happy, they get to keep the account un-defaulted so if I do ever stop paying them, they can hold it over me and do some serious damage. She confirmed it on their electronic complaints portal which I've taken a copy of. Like I said, proof will be in the pudding and if they actually do it with the CRAs so I'll keep an eye on it.


    In fairness to Barclaycard since my whole mess started they have been fairly good. Immediately stopped charging interest and fees, always accepted my payment proposals from CCCS/StepChange and never once sent me barrages of threatening letters and its been nearly 8 years now.


    I do wish the CCCS had advised me to go for an IVA - as it would have been over 2 years ago - but what's done is done and its too late now.


    MBNA are still being !!!!!!! Sent them a letter today with copies of 22 letters they sent me over a period of 18 months telling me they were "about to" default me, my payments weren't enough and that on four occasions, I'd been referred for legal action as I obviously had no intention of paying.


    If that wasn't grounds for a default back then I don't know what would be. I'm guessing they are not going to shift their resolve so I've asked them to confirm that their next response states (if they aren't correcting the problem) that its their full and final position.


    I actually spoke to one of their advisors who agreed with me - that they had disadvantaged me by not defaulting my account but he could do nothing about it - and not to worry, in 10 years everything would be back to normal! Because we all have the odd 10 years to sit around waiting!


    Anyway, the Barclaycard department I spoke to was on 01512685601. I didn't catch the ladies name unfortunately - I'll check if its on the portal.

    Hi All,


    Just a quick update, I checked my credit reference agency files with all three agencies today and sure enough, Barclays have removed all references to the file and are no longer reporting it.


    Still waiting on MBNA who are looking into my complaint.

    Hi has any one that had there barclaycard account removed now found them back got my noodle report today it's back on dated the 20 th June not been on till march i phone them tomorrow to see what s happening
  • Hi had my complanet rejected by fos seems fair to report arrangement for 18 years sorry

    I had the markers reappear after taking them off on both Callcredit and Equifax - but not on Experian.


    I contacted Barclaycard again and spoke to one of their tier 2 complaints handlers. He apologised profusely and said he would investigate what had happened. It took a couple of weeks and he said that agreeing to remove long term AP markers was a new thing for them.


    None the less, they removed them again (checked on all three CRAs) and credited my account with £100 for the inconvenience. He also said that if the markers reappear, contact them again with my original complaint reference to rectify things.


    Seems I've had a very difference experience to many others. The only thing I can say is that prior to going on a DMP I never missed a payment and since being on a DMP I've never missed one either, but in fairness to them, they have been really helpful.


    MBNA on the other hand! Complaint has now gone to the FOS! Refused to help at all! Said it was their policy to use AP's if debtors could repay within 10 years - which definitely puts anyone in a worse position that someone who makes no effort to pay as any damage would be gone in 6 years. Also said they do not default until 6 payments have been missed. On the upside my original plan would have taken more than 10 years and I was 8 payments behind when they introduced it. Fingers crossed!

    My complaint to the FOS was rejected too although the guy I spoke to was sympathetic and agreed that while in principle AP is better than a default the reality is that it has a negative impact way beyond the 6 year life span of a default...

    Then again I'm "lucky" as I'm probably going to lose my job through ill health soon anyway and then I'll have little option but to go either down the DRO route :(
