Barclaycard AP removal [successful]

    You need to get a final response in writing from Capital one.

    They almost always get rejected like this when you query with a CRA.

    I've got a letter somewhere from Capital One when they said the matter was "closed" as the markers were being removed from my files.

    This was over four weeks ago, but I looked at my £2 report from Equifax the other week and it's still showing on there.
    It's not your credit score that counts, it's your credit history. Any replies are my own personal opinion and not a representation of my employer.

    Maybe try calling capital one for one more go. That will be quickest.

    Or give the FOS a call, but that may take a while.

    I've posted a letter to Capital One and also sent a scan of their letter they sent me on the 22nd of May to Equifax.

    Ok, so Vanquis are refusing to play ball with me, but I have noticed that the date the first AP marker they placed on my credit file is about 4 months prior to us starting the DMP - therefore, I would 100% not have been on an 'Arrangement' with them.
    Does anybody know if a bank is obliged to provide evidence of the date that they accepted an 'arrangement'? - i.e send me a copy of the letter that they should have sent at the time saying 'we accept the terms of your reduced payment'.

    Not sure if it makes a difference or not, but our DMP started in May 2008 - so that would be roughly when they were notified by me telling them that we are going on a DMP.

    Sir/Madam,

    I refer to the above mentioned Barclaycard Accounts which is being reported on my credit reference files.

    Barclaycard has been reporting arrangement to pay markers (APM / AR) on the above accounts since 03/2007 - over 7 years , which places me in a disadvantage compared to a debtor who has had an account defaulted .and therefore will continue to appear on my credit file until March 2020 It would appear that Barclaycard has used arrangement to pay markers in place of a default on the account, It is understood that the Information Commissioner's Office does not agree with this and states that this is Unfair practice.

    The definition of a default
    9 A ‘default’ can be said to occur as soon as a borrower fails to meet the terms of their credit arrangement.


    An ‘arrangement to pay’
    21 This involves a temporary, short-term (up to six months) arrangement where the lender agrees to accept reduced payments


    I believe therefore it is against Information Commissioner's Office guide lines for this debts not to have been defaulted on or before 03/2007.

    I ask therefore that you place a default date of 03/2007 with all 3 credit agencies for the above 3 accounts. This will bring it in line with my other debts that was all defaulted at same time on entering my DMP

    These AP/AR markers are likely to cause considerable problems to me financially as the account should have been defaulted in 2007 and the default removed in 2013, this data will be displayed nearly 5/6 years longer than necessary.

    I will continue to pay payments on these accounts until fully paid

    I look forward to Barclaycard sending a prompt and proper reply.

    I have adapted the above letter and sent it on yesterday and today I had a phone call from Barclaycard and they have said that they can't do anything as it was a true representation. They said whilst in hind sight I would have been better off in a default thats its too late now. I said I know of people that have had results having had the same problem I have said I am not satisfied so I have asked for it to be escalated.

    Any advice ?

    Oh dear, I was just about to post the same letter off to barclaycard regarding my AP markers from 2011 :(

    Don't back down. I think it just depends on who you get but clearly it has been successful for lots of people. They have escalated mine and I have told them I have taken them to the FOS before and won despite it taking me 18 months and that I am prepared to do so again so fingers crossed.

    Hi,

    A while back, I had issues paying a Halifax overdraft. This has been reported as a series of (3) late payment markers:

    Settlement Date: 09/03/2010
    Last Updated: 11/04/2010
    Account status 1-12 Months: 003333333333
    Account status 13-24 Months: 210333332100

    Now, normally this account will fall off 6 years after the settlement date - in this case March 2016. However, the late payment markers go all the way back to July 2008 - which if this was a default backdated to the first late payment, would mean this account would fall off next month.

    My question is: are the late payment markers treated in the same way as prolonged (6+ month) recording of AP markers by the ICO guidelines? And would it worth me trying to get this converted to a default backdated to June - September 2008?

    Don't usually issue defaults until 3-6 months in arrears.

    Overdrafts are funny. They can happily just pick up the fees each month.

    Why was it reported as late?

    Were you paying in each month?

    Why did the late markers get better or worse in subsequent months?

    Key is proving that's unreasonable.

    The O/D was reported as late as the account went overlimit and I was not paying any money in (I had very little income, and lots of other debts at the time). The month when the O/D was reported as (0) was when I paid in a £500 lump sum to clear off part of the overdraft. I eventually managed to pay off the remainder of the overdraft (~£1000) in a single payment and close the account back in 2010.

    All other months I was not making any payments.
