UNIQUE(ish) issues with G24 & POPLA - HELP!

    I think that should be an email to the lead adjudicator ... See the people.org.uk/complaints.htm page. Use the enquiries @popla.org.uk email address attn. The Lead Adjudicator.

    I'd be tempted to not use the word harassment but to say perhaps:

    "I have found the lack of understanding of this issue has been very distressing and therefore you ask that you carefully review the situation. Regardless of the original appeal, POPLA will be well aware that in neither case is it likely that the parking company could demonstrate a genuine pre-estimate of loss so perhaps cancelling these tickets would be the easiest way without spending excessive time on investigation."

    In other words, if you don't want to admit your made a mess of it, I've just given you the magic code word for dropping this like a stone.

    **edit: sorry, i reread your message and it made sense. when i go to the (what i assume you meant popla.org) complaints page, i am taken to londoncouncils.gov.uk/aboutus/governance/complaintsprocedure.htm which states:

    "We can investigate any of the following through our 3 stage complaints procedure:

    an unsatisfactory level or quality of service;
    concerns about service delivery or non-delivery;
    a failure to provide information or give the correct information;
    a failure to follow the London Councils agreed policies and procedures;
    a complaint about the behaviour of staff or contractors employed by London Councils "

    is this what you mean by lead adjudicator?

    I'll re-iterate my previous advice which I recommend you follow unless you want to burn your time - IGNORE G24 unless you get court papers.

  • Sorry for the typo, I was referring this:
    If you wish to make a formal complaint about specific alleged misconduct by an Assessor, it would be investigated by the Lead Adjudicator. However, this is not the same as merely disagreeing with the Assessor’s decision.

    On popla.org.uk/complaints.him

    So simply email popla using their normal email address for the attention of the lead adjudicator as there has been an error.

    Could you have a quick look over my next email to SC before I send?

    "Dear Mr Clarke,
    I didn't hear anything back from you regarding my situation, though Mr Reeves of POPLA has sent me an email yesterday again stating my appeal has been refused. I don't know whether his communication was a result of your enquiries on my behalf or just a coincidence.
    No-one seems to understand that there were two of these unenforcable 'invoices', one of which is closed, and the current one which should never have been considered by POPLA as I didn't have chance to appeal myself. This confusion by considering two completely different cases in the same appeal is completely exhausting, as I am the only one who seems to fully understand that I didn't appeal this current case to POPLA.
    I know mitigation isn't something that POPLA are interested in, but I am begging you to do something to disentangle their complete bungling of this matter.
    I am a xx year old student, currently in my final year of university and under incredible stress on all front; personal issues, university workload and deadlines and now this ridiculous parking charge situation. This whole fiasco is stressful and maddening.
    My only contact with G24 in this case was before I received any online help, where I ask G24 to allow me to pay the reduced amount as I never received the Notice to Keeper. Suddenly I'm slapped with an evidence pack of confusion from POPLA stating that my 'appeal' has been refused and I now owe £100.
    I have been repeatedly advised to email you directly, though I have also copied in your investigation team.

    And Hot Bring, please don't think I don't read/value your advice, I am just very apprehensive of simply doing nothing when there are ways to try and gain closure on this, rather than waiting.

    I am currently drafting an email to POPLA lead adjudicator, will post here when I have finished.

    No problem - as always each individual needs to decide what course of action to take. I'm not critical of your attempt to sort this out but just think with the other things you've listed going on in your life that ignoring it all would be the simplest and easiest option.

    G24 really are all bluster and no trousers - when it comes to the crunch they give up. Look at this thread if you need evidence about how upset they get when someone stands up to them :D

    Hahaha Hot Bring, i didn't realise about the 'kisses', that is just my name, you gave me a laugh!

    Here is what i plan to email to POPLA lead adjudicator:

    "Dear the Lead Adjudicator,
    I would like to bring to attention the errors in the case xxx.
    If you would look through your records, you would see that the case stated involves a pay and display machine where I provided proof of purchase, which was then closed. Case xxx has nothing to do with the unenforcable invoice PCN xxx which involves a free car park for the retailer B&M.
    That the two cases have been confused into one POPLA appeal is very incompetent, and the fact that this has not been realised is ignorant as it shows that proper attention has not been used.
    I will not be paying the invoice of £100 as this is not a genuine pre-estimate of loss for a 19 minute overstay in a free car park. Given that £90 is charged regardless of the length of overstay it is clear that there has been no consideration as to what would be a genuine estimation of loss, especially since the car was parked without causing damage or obstruction which may incur a cost.
    I also do not know why the charge has increased from £90 to £100.
    This ordeal is extremely exhausting - for me, as it is obvious that due care and attention has not been used on POPLA's part.

    Other than the formatting ( which I think is a cut and paste issue ) this will be fine. It's getting the BPA involved that is the important point. You might want to add the following as your closing sentence :

    "If you require any further information to investigate this matter then please contact me."

    Obviously you won't provide them the drivers name though !

    Both sent, now waiting to hear back from all 3, manager, POPLA and BPA.
