I'm not trying to be awkward here, but if you're actually going to get anything other than goodwill from Aviva, then all it's going to take is somebody to actually ask for evidence... For all the poster knows these calls could have been generated because of tip-offs from emergency service personnal who may have been called to the accident or took a report over the phone, the recovery company who removed the vehicle to a garage/storage yard, the storage company or garage employees, the engineer sent to the garage to inspect the vehicle, a hire car company that may have provided a vehicle whilst his was off the road and I am sure there are many other spokes in the wheel.

Aviva have admitted that one of their employees stole the data and sold it. No need to look any further as to who is to blame.

All very interesting. I'm another victim of Aviva's incompetence and have repeatedly complained to them up to CEO level. Every complaint has seen them deny any wrongdoing.
Then, lo and behold, an item appears on the BBC website but apparently I wasn't affected. Lies lies lies. Despite 13 months of calls, up to 5 times per day, 6 days per week they claim it's nothing to do with them and have blamed everybody else but themselves.
It's now with the Financial Ombudsman, I've spoken with ICO and may make a formal complaint to them despite receiving two very different types of advice.
Can anyone guess the regional accent of these callers??? Where are Aviva Insurance based?

Didn't you see the Watchdog program about insurance companies receiving a fee for the drivers details of anyone involved in an accident?
It appears that it is common practice rather than a few rogue employees.0 -

No, I didn't. First claims company call was received the day after a very minor (not my fault) accident. No Police, no ambulance, no fire engine).
Aviva are claiming that every time a person accesses information about a claim on their system then an electronic footprint is left. It's entirely feasible that an employee taking the original call could hand write the customer's personal details.
Interested in this subject access request so will try and find out more about that.0 -
As the people who acted illegally were employed by Aviva and given access to the data by Aviva, does this make Aviva liable due to a breach of the Data Protection act?
I've asked them for compensation and requested the name of the people who sold the data so I can bring a civil case against them. I've asked for a subject data access form so I can see everything they hold on their files. They are bound by the act to provide everything within 40 days.
This has happened to hundreds if not thousands of people, if complaints become collective they will carry more weight with either Aviva, the ombudsman or the Information Commissioners Office.
I'll keep posting of all correspondence, hope others do too, to offer advice and information to others who are trying to complain about this illegal practice.
Thank you for this and look forward to updates. As you say, we all need to take action and a subject access request will be the next stage for me.

I havent been involved in accident but still recieve these calls. It is a nuisance that shouldnt be afflicted on people going about their lives minding their own business. Good luck Paul.0
