OPC Parking Tickets issued at flats - WIN AT POPLA!!
Comments
-
The permit is placed at the top centre of the windscreen immediately in front of the mirror. Its the 'white square'.
I suppose I am getting hung up on it as OPC issued the ticket on the basis that no permit was displayed - how do I argue that when their photo deliberately ignores the obvious permit at the top of the screen?
Once again, thank you for the support.0 -
Right think I've got it now - it is really quite obscure so - this you would have to highlight this if you choose to add as evidence. If you also take your own photo where this permit normally is, close up as comparison to add.
HOWEVER AS STATED ABOVE - IT REALLY IS MORE IMPORTANT TO SEE A COPY OF THE SIGNAGE - we need to know on what the wording states to help with appeal wording.0 -

Understood...I will post the signage photos asap.0 -

I think once you get to 15 posts you might find you can start posting working links! Anyway have we seen the SIGN they are relying upon please, and the Notice to Keeper that was posted out to the keeper?
Haven't seen an OPC one in ages and they were always worth a laugh previously with their documents and letters and understanding of the law. So we should check the signage and NTK for you.
You will win at POPLA but we want to get it right. Part of your POPLA appeal can be about the permit but mostly it WILL NOT focus on that at all.
Ignore little Orphan ''Annie'' on here who clearly works for a PPC.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I took a photo of the main parking signs which are located in and around the parking area. For speed here for forum advice I have typed word for word from the photo onto this post - see below.
OPC PARKING RESTRICTIONS
THIS AREA IS PRIVATE PROPERTY AND A CONTROLLED AREA
BY REMAINING IN THE CONTROLLED AREA (THERE IS A MAP ABOVE THESE WORDS) YOU AGREE TO BE BOUND BY THE TERMS SET OUT BELOW
IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS PLEASE LEAVE THE CONTROLLED AREA IMMEDIATELY. DO NOT PARK YOUR VEHICLE OR WAIT IN THE CONTROLLED AREA.
This is a private area in constant use by people who are using the private area with the owners permission.
To discourage unauthorised use of the area a charge will be made to anyone who uses the area without authority.
Details of the circumstance where you will be liable to pay charges are set out below.
The charge for unauthorised use is £100 (£50 if paid within 14 days).
Repeat charges will be levied on a daily basis.
You will be liable to pay the parking charge if you, as the driver or registered keeper of a vehicle:
Park not clearly displaying a valid OPC parking permit within the front windscreen.
Do not park within a demarcated parking bay.
Park on access roads or within the reception area.
Park on yellow hatched areas or the red lined areas.
Park causing or leading to cause an obstruction of the throughway for other users.
Contractors / Loading / Unloading will be allowed to complete their task providing activity is seen to be taking place and the vehicle concerned is not causing an obstruction.
General Conditions
· Parking tickets may be issued by OPC private parking attendants or by post through head office.
· Where necessary the DVLA will be contacted to obtain details of the registered keeper.
· In all instances digital imagery will be taken and may be used as evidence.
· The ticket will contain details of how to make payment
· If payment or an appeal is not received with 28 days of the ticket being issued (see below for details) debt recovery action will be instituted which may include county court proceedings. You will be liable to pay all additional collection costs including legal costs and court costs.
Removal of Vehicles
· OPC reserve the right to remove vehicles to a secure lock up if you persistently use the private area in an unauthorised manner. You will be liable to reimburse all costs incyrred in removal and storage and your vehicle will not be released until all debts owed by you to OPC have been paid
· Any vehicle that is not collected with 14 days of removal will be sold and the proceeds applied towards discharging your debt.
· OPC reserve the right to remove and dispose of any vehicle which they may consider poses a risk to health and safety
For further information about this scheme, the parking charges or to lodge an appeal in regards to a parking ticket please write in the first instance to:
OPC P.O Box 956 St Albans AL1 9HJ
For general enquires only telephone 0844 264 0711
For payments only telephone 0844 264 0712
So that's the sign that OPC display.....
Grateful for your views about how I write my appeal to POPLA based on the above.
Many thanks for all your help! :A0 -
Is that the EXACT wording please confirm.
Do not park within a demarcated parking bay
Very carefully contrived to attempt to conceal the basis of charges.
What do they call persistent offenders - and removal of cars in a security key fobbed access to private property - I would call that theft ....
CM - this OP appealed after windscreen ticket - so no NtK to inspect!
Actually OP can you upload your windscreen ticket for inspection - please remove all identifying information - car registration/the parking charge notice reference number/place - so we can inspect wording.0 -

- now that's a strange one - is this a mistype!

My post had the Exact wording from the sign.
"Do not park within a demarcated parking bay" - double checked and this is the exact wording - no mistype!
Can you explain what 'CM' and 'OP' mean please?
When I was in the car park looking around I noticed several vehicles that appeared 'dumped' and not taxed - one has been there since 2006 apparently.
I will upload my Windscreen ticket...though again for speed I can type it all up as per the Parking sign? Any thoughts?0 -
CM - is my abbreviation for coupon-mad
OP = original poster - i.e. you in this case.
It would be better to see the actual ticket - just do it to tinypic - although you should be able to post the link yourself now. It would be good also to check the sign - as we look for other things like the correct logos and wording size.
Also is there a sign at the property entrance - again this should be of a specific size and format.
LOL then Do not park within a demarcated parking bay
where do they expect you to park then - they can't issue a ticket if your outside the bay!
Sorry can't remember start of thread -
are you renting or is this your own property?
What are the terms of your rental agreement or defined lease agreement regarding parking and permits?

That sums up the illiteracy of OPC. I did say above ''they were always worth a laugh previously with their documents and letters''!
But we need to see a photo of that sign really (it's easier to see a pic!) and we need to see both sides of any NTK letter.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
