If I've got the PPN I must appeal as the 'Keeper' at this stage I assume?

Why are you calling it a PPN? Do you mean PCN?

Did you receive these through the post? If yes then "keeper" is correct, although in this case it doesn't really matter.

Hi OP can you upload a photograph of the windscreen shot when you get the opportunity?

I personally wouldn't bother with POPLA as it would be up to the PPC to prove that the permit shaped object in your windscreen was not their permit and, having failed to photograph it to prove otherwise, they wouldn't be able to prove otherwise.

Certainly most of the larger PPCs, once you get passed the payments office goons would cancel this without question.

[provided of course their permits aren't say square and the obscured object is a circle or similar, which I know has happened before.]

You might want to issue them with a cease and desist warning of harassment.
The "facilities manger" will be the one ticketing the car to get his £17 commission.
So he might need one as well.

Why not? When "playing the game" can get this killed stone dead.

PS, get yoir company to ask the solicitor to look at this lease and the fact the parking company are harassing one of their employees, if the lease makes no mention of this permit, they might be illegal conducting commerce upon the leasehold.
A bit like someone can not set up a market stall on your garden.
    Be happy...;)

OP - please ignore this advice. With POPLA you need a robust appeal and the issue goes away FOREVER. Don't go to POPLA and the PPC have the next six years to take you to court.

Not using POPLA is VERY poor advice.

I specifically said I personally wouldn't provided I got past the payments office goons and onto a director of one of the larger PPCs. A five minute chat with said director is far more worth my time than spending hours constructing a POPLA appeal. Each to their own.

I've read hundreds ( possibly thousands ) of the threads on here including many by seasoned regulars such as Coupon Mad, KIL, HO87, Guys Dad, Redx and nowhere have I seen anyone say they've ever managed to speak to a Director of a PPC. Why would they talk to you ? They are running a scam not a real business.

How have you managed to speak to PPC Directors ?

A POPLA appeal can be written in less than half an hour. I'd imagine even if it were possible to talk to PPC Directors it would take more effort than 30 minutes to get them to take your call.

EDIT - and I foolishly left 4consumerrights off my list ..... doh !

I actually tried to speak to a director once - heard voices in the background and then was told he was out - requested that the message be passed on that legal action was going to be taken against his company.:rotfl:

This is not even a large company - I am very surprised at this attitude Annie especially in light that you actually identified a real issue on another thread regarding legal action. Your advice also to ignore POPLA is wrong.

However, I do agree that this OP could consider sending a cease and desist letter like the one on Tospig's thread. I have helped several cases off forum with dealing with parking charges at their own properties. I am considering suggesting joint claims be made with individual companies - if there are enough numbers.
  • O.K - This thread that seemed 'on the rails' yesterday has seen some confusing posts (IMO). I would really appreciate what action I should be taking now.

I do not want to be the FIRST FAILURE at the POPLA stage, so please bear with me and help me through this difficult time.

    Many thanks
