    **UPDATE**

They have not provided any actual costs, saying they had to be removed (not sure if they are on the copy they sent to POPLA)

This is not allowed. Both POPLA and the motorist must see the same information.

You need to email the whole evidence pack you received to POPLA and state this is what you have received.

If this is different to the evidence pack POPLA have, ask POPLA to either send you the full pack so you can review it, and adjourn the case for 7 days to give you time; alternatively adjudicate the case on the evidence pack you were sent.

Are the signs mentioned accurate to the car park? Did they have planning permission to erect them? Does the contract state clearly the PPC can take action on behalf of the landowner?

All appeal failure points in addition to those already mentioned.

  • **Update - POPLA WIN**

Reason - Operator could not provide evidence of GPEoL. No other points addressed.

Just wanted to say a massive thanks to everyone for their valuable input. Consider hands shaken and pats on back. :)

Should I copy this post along with all the other wins?

I'm gonna use the money to donate to this site. If anyone would like further details about this appeal and the decision, please message me and I'll be happy to contribute.

Yes please do post your win in 'POPLA decisions' with a copy & paste of the decision and a link here too, stating which PPC you beat. Well done, we told you so!

Excellent news, well done. When will the PPC's realise they have to show a GENUINE pre-estimate of loss?

Actually, it was effectively a PSDSU and not a failure to show a GPEoL. ;)
  • OK! ;) Explain the distinction?

Reading the assessment it indicates that the PPC offered no evidence to POPLA, not that their evidence wasn't believed ... ergo Parking Scüm Didn't Show Up ;)

It doesn't say they didn't turn up. It says they did not provide any evidence to substantiate their claim for losses. They may or may not amount to the same thing.
