  • JUST BEEN DOING RESEARCH AND HAD A THOUGHT...

    My original appeal (3 months ago) was neither acknowledged nor a decision returned in writing (email).

    I was reading the BPA code of practice and found this:

    22.8
    You must acknowledge or reply to the challenge within
    14 days of receiving it. If at first you only acknowledge
    the challenge, you must accept or reject the challenge in
    writing within 35 days of receiving it. We may require you
    to show that you are keeping to these targets

    If this has been contravened, is the charge thus void??
  • You are correct with the BPA CoP.


    They will, of course, deny ever having received your appeal. This is a favourite trick of PPCs - i.e. lying through their teeth, but particularly "losing" mail, whether physical or electronic.


    You will, no doubt, have a copy of your original appeal email. Was there not even an auto-response when you sent it? Just forward your original appeal telling them that you did so, here it is again, now just process it in the normal way.


    The charge is never "void" (in the PPCs' minds). The don't play by the rules, this isn't governed by statute, so it doesn't stop them pretending they still have a case.
  • I do have the original timestamped email. The address was correctly entered and I have checked junk mail etc.

    Of course I am expecting them to deny receipt but would this not be thrown out of court if it ever went there, or at least make it very difficult for them to pile the costs up or whatever they do?
