If this has been contravened, is the charge thus void??
Nope. You would do better to start by reading the sticky threads for newbies to read first:

    https://forums.moneysavingexpert.com/discussion/comment/64274803#Comment_64274803

'How to win at POPLA' is there too in the 'NEWBIES please read this first' sticky, as well as the emails for the BPA and DVLA.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD
    • OK so a reply has been received now.
    • Appeal was declined.
    • POPLA code issued
    • My comments about their lack of reply to my original appeal, and not giving me opportunity to pay reduced amount was IGNORED.
    • Full payment of £80 demanded within 28 days.
I took the honesty-is-the-best-policy approach to start with and genuinely wanted to play fairly. However due to their outright dishonesty, I've changed my mind so going to make it as difficult and costly for them as I possibly can.

Where do I go from here?

You draft a POPLA appeal and post it here for comment, redacting any personal or identifiable info. You know - exactly as the NEWBIES sticky told you. ;)
  • OK at this stage I have absolutely no idea what to base my POPLA appeal on! Any ideas?

How many times do we need to say - NEWBIES sticky thread? (Post #3 of it).

This is like pulling teeth. Why do you and other newbies think I wrote the NEWBIES thread? PLEASE read it!!! Post #3 has a hyperlink, 'How to win at POPLA'. What more do you need than those examples? Surely you can see we can't type an individual 'same old, same old' answer every time...all you need is to adapt an example.

This is as easy as pie for you now so get off your own thread and read the sticky info! Apols for the rant but this is silly. I already said this in post #22 above...

  • Sorry guys that was a bit naive. I haven't had any time to research anything at all and was led to believe from a previous reply that I could just jump back to this thread and I'd be guided.

    Anyway

Trying to do some research but really no time so may well be cheaper just to pay up :(

I am sorry how can t be cheaper to pay ? We cannot do everything for you as this is your situation and you need to explain it in some of your own words, most of the work is done. If you can't spend a couple of hours on this then we cannot help you. You need to know what you are writing to continue this, its not rocket science, its all explained for you
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • Eesh. I know, look, I'm apologising. I've done all this in a real hurry.

    ANYWAY

I'm in the process of constructing a POPLA appeal. Watch this space.

Thanks very much in advance for all your time, I don't want you to think I'm ungrateful.
  • Thts good post it up here when done. Don't forget no mitigation at all. When it's done we will critique it and advise any changes etc
