Private PCN - No reply to my appeal after 3 months, then...

    Does the PCN mention breach of T&Cs or not authorised or no permit?
  • NTK says 'breach of terms and conditions'. (I haven't got the PCN to hand)
  • No GPEOL is fine for this lot
    Just do as you have been advised and send it it off

    QUESTION:

    According to the Ts and Cs, the car park claims a contractually agreed sum, not that of damages etc. In my appeal, I only refer to GPEoL. Is this going to be a problem?

    Sorry to say this is a mess of a thread and if you have sent that POPLA appeal off then you have rushed it and I am wondering why?

    We don't even know who the PPC is - you have changed it in every other post and I am wondering why?

    In your first post you said it was £75 for not displaying a ticket but then in your POPLA appeal you said £80 for overstay?

    And you've suddenly mentioned it was a contractual fee!

    This is either a PPC wind-up or you need to share some proper information with one of us regulars.

    As you haven't given us all the information yet, if you have submitted that POPLA appeal then I can tell you that it is NOT one which this forum has provided and if it loses then it would not be one of 'ours'.

    I am concerned as to whether you are a genuine newbie - to prove that you are, perhaps you could pm me a copy of the NTK and a picture of the signage and then I can tell you if 'your version' of a POPLA appeal is going to win or not.

    Yes it was a contractual fee.

    I didn't think the exact amount was important, just that it was around-about that amount.

    It was non-display of a ticket.

    I used the term overstay, is that relevant? I was confident I had all the main points in there and that GPEoL/punitive/unreasonable grounds would win alone anyway?

    kirbyinfurnesslad seemed pretty confident that it would win without even asking to see a pic of the t&c's or the NTK/PCN??

    Anyway its too late now as ive sent it. If it loses then of course its my fault.

    I swear this is genuine. Anyway it only leaves me to let you know what the result is.

    Because you lied about which PPC it was.

    Not with a contractual fee, no 'GPEOL' anyway. And punitive/unreasonable doesn't win diddly squat at POPLA. Your posts have confused us as to what the contravention/event was, what the amount was and which 'lot' you are dealing with! It makes me think you are a PPC poster trying to hide the info then tell us later when the appeal YOU came up with, might not win.

    So...please show you are genuine now you have submitted a POPLA appeal...which PPC?

    If it's Combined PS or District Enforcement or Secure-A-Space (or other PPC known to use 'contractual fee' allegations) then you have misled us.

    And you can email POPLA to add more info so it is not 'too late' if you want to come clean and tell us who this is to get some final specific help. If you are genuine we want you to win - and so would you!

    I didn't realise you can amend the POPLA.

    What else do you need for me to show you this is genuine? I was warned not to disclose too much info which could identify the claim to a PPC.
