    Buying a car doesn't just mean you pay your money then that's it, they are machines which require a constant feed of cash, older they are the more cash required to keep them going.


    TBH there are many factors in which a small dealer becomes liable for a spring or clutch.


    a clutch going give searly warning signs, even after a month there would have been signs it was going way before that even when the previous owner had it. so as small traders and main dealer TEST their vehicles before sale it would have came to light, but lets face it a small traders not going to replace it but they will have knowledge of it hoping the person who views and buy it have no knowledge of mechanics at all and release themselves of the cost of it, then blame the buyer for riding it when it goes a few weeks later.



    so with this in mind if a small dealer decided to play the hard ball game with me, I'd have a copy of his online advert stating its condition, I'd have a copy of his website statement if he has put all vehicles tested before sale, and I would have a detailed report done on the clutch itself, reason for failure how long symptoms would have been present.


    then I would put it to him, so do you want to repair/refund the cost of replacing it because I can prove it was faulty at purchase with the report and may have prior knowledge it was failing when you tested it before sale, or does he want to give me a refund because it wasn't as described by saying it was in good perfect working order or in good condition and its not fit for purpose.





    clutches can cost a lot of money, even in a 10 year old car depending on make and model.


    a snapping spring even, if a advisory on the MOT advert says corroded spring, and then snaps thirty days later I can prove the spring had issues at point of sale. I would expect a small trader to offer at least a contribution toward the repair costs.
    and if it snapped 2 days after sale I would expect him to replace it free its not fit for purpose.

    Have you seen "The Sheriffs are coming" seems to be plenty on there whove bought old bangers & get their money back.
