Sold as seen - Is this legal?
Hi,
Bought a car from a trader. Well it said trader on Auto Trader. I have a screenshot of this as the ad is now gone since the car is sold.
If on the receipt it says sold as seen does this mean tough if it breaks.
I have had it since 20th January 2014. I part exchanged my car in for it and he filled in the traders part of my old car's V5.
Basically there are a few problems which was never mentioned in the ad.
Erratic speedo (Common on my car. Easy fix if nothing is seized) Speedo sometimes reads 0 while I am travelling causing the car to judder as its not getting fuel.
Tonight the front wheel started to knock. Only for about 20 seconds then it stopped.
Has a squeak on engine.
None of this happened when I took it for a test drive.
Do I have any come back with this?
The car is a Ford Focus 1.6 Ghia 2001.

No comeback, but the speedo reading zero will not cause fuel to stop flowing. If the rev counter shows zero because the engine has stalled, that will cause the fuel to stop, but that's not the speedo.
You've bought a 13year old car, I'd guess for less than £300. Does it have an MOT? How much fuel is in the tank?1. Have you tried to Google the answer?
2. If you were in the other person's shoes, how would you react?

The car has MOT until Dec 2014. The tank has over half in it and the car will judder as the ECU is reading the car as not moving as the part thats not working correctly tells the ECU has fast the car is going.
So when it stops the ECU thinks the car needs no fuel. The car judders.
And I paid £9000 -
sold as seen no warranty given or implied is what i would put on receipt for a car that i was selling as a private seller
if he is a trader then you should expect the the car to be fit for purpose

Um, no. The ECU does not control fuel flow based on speed. If it did, you would never be able to get a car moving. It bases flow on throttle position and revs (and loading) If the revs are low and the throttle is not pressed, then little fuel will flow.
As for paying £900...

Buying from a trader the Sale of Goods Act applies and you have a right to expect the car to be of satisfactory quality. Obviously that doesn't mean that you can expect a 13 year old car which cost £900 to be as good as a new one. It may have
(1) General wear and tear of the type you'd expect in a car of that age, price and mileage (ie probably quite a lot)
(2) Specific faults which were pointed out to you at the time of sale
(3) Specific faults which weren't pointed out to you and which go beyond the general imperfections you expect in an old car.
(1) and (2) are fine, but (3) gives you grounds to demand your money back. Writing "sold as seen" on the receipt doesn't change that - the trader can't avoid his obligations under SoGA and if there were specific fault which he didn't want comeback on he should have pointed them out to you before money changed hands.0 -

FORD FOCUS 2.0LT SPARES/REPAIR, 2001, a car being sold with 2260 miles on it if it been around the clock then say it has, no MOT no tax and no service history
hardly a good example, buy it for £450 and spend £900 to get it on the road .0
