After ATOS assessment, have been taken off ESA

We did and it was easy. We could have kept quiet about the adaptions that we have made to our home which now reduce my wife's needs in respect of her AA claim. If we had she would still be receiving her award. They are easy to get and just as easy to lose.
As for ESA, if you can put up a very convincing show at a face to face you are almost 90% on your way to getting an award. I had an assessor tell me last week that she 'will do everything she can to make sure I get an acceptable award, but couldn't promise anything, but you should be alright'. No independent evidence has been submitted so we will see.
(Mind you PIP is a totally different proposition, many that claimed DLA are in for a very big awakening).
And yet, I, and many, many others have a lot of home adaptations, which have no impact at all on their AA or DLA......
You and the DWP seem to be operating your claims and reviews on a different parallel to the rest of us lol
As for PIP, well, it is still bring reviewed/audited, and very few results have come through yet, but those that have suggest that anyone on either middle rate or high rate DLA are having very few problems with getting PIP.

You also say above it was a very slow inclined treadmill BUT
so was it slow or brisk ??!???!?
2 and 3 hours brisk walking and numerous threads about climbing stairs for fitness .... When the dla criteria for high rate mobility is
"Mobility component
You might get this part of DLA if, when using your normal aid, you:
can’t walk
can only walk a short distance without severe discomfort
could become very ill if you try to walk"
How can you walk briskly for 2 and 3 hours and meet the above criteria.... No one on this thread has tried to state their disability is worse....
you have been challenged about climbing stairs and brisk walking when you have stated in other threads you can't walk or stand unaided.

On the grounds of been "virtually unable to walk" to claim HRM DLA someone can get it even tho they can walk but on the basis they are either in significant pain, need aids, or walk in a improper manner, given how he has described his treadmill I would say he clearly qualifies and hasnt commited any fraud. At least he is trying to improve his health with what he is doing.
Funny doctors advise exercise etc. to improve mobility, if a patient tries it people are all too quick to shout benefit cheat.
Regarding the ESA situation.
ATOS are supposed to take into account if a medical professional has deemed it unsuitable to use a wheelchair, so eg. if you have been told using a wheelchair isnt appropriate for your condition and still cannot walk 50m normally then you supposed to get 15 points on a ESA assessment for mobility and support group, of course whether that happens in practice is a different story.
Personally I think the way ATOS can 'pretend' people have aids and treatment they dont have access to such as wheelchairs is very wrong and am very surprised noone has tried to challenge it yet.
In the OPs case tho if he actually has a wheelchair his argument for mobility under current DWP legislation will be tough but there is going for the exceptional circumstances where if can argue if was made to do work related activity or/and work then it will be a danger then can maybe get ESA back, I would appeal right away dont bother asking for a reconsideration, they will do one anyway if you appeal.0 -
yeah forgot about that sorry.0

I am genuinely interested ... If that makes me "rude and ignorant" so be it. I am genuinely staggered that regular "brisk uphill walks" for 30 mins to 3 hours is compatible for the discriptiors. Especially when In the first post she states she can't walk.
Can't imagine that many assesors would agree with you on this point... Although i will eat my hat if her dla form mentions the level of exercise she has posted about on the loose weight thread.
Unless you mean the severe discomfort mentioned below ..Crikey, repeatedly climbing stairs really hurts...
Crikey, repeatedly climbing stairs really hurts :rotfl:
Ouch, ouch, ouch...
And I am genuinely interested in why someone that has a balance problem and uses a walker indoors has decided on climbing the equivilent amounts of flights of stairs to the height of everest as their form of exercise....
I'm sorry but someone that says in one post they can't stand or walk and also posts about brisk walks for 30-mins -3 hours holds no credibility to me.Spelling courtesy of the whims of auto correct...

There are some people out there with no walking problems who can't even walk for that long without having to stop.Sealed pot challenge #232. Gold stars from Sue-UU - :staradmin :staradmin £75.29 banked

Well I know you not a doctor thats for sure.
In cases of where people have diffilculty walking, I know first hand the #1 thing advised is to walk as much as possible.

tbh, though, had the poster detailed the level of exercise undertaken, on their DLA form, there's a very strong possibility they would not receive DLA.
I have difficulty walking, to the point where there are days I can't actually walk at all and the #1 thing advised to me, was not to walk as much as possible. There is something delicious about writing the first words of a story. You never quite know where they'll take you - Beatrix Potter0 -
From my own experience, I would say that although you do need to push yourself, I would not, under any circumstances, be able to do what the OP does.....I wish!!!!
Even if it's just a breathing problem preventing mobility, again, not too many would be able to sustain that level of exercise!
I don't judge others, and claims are best decided by professionals, and not armchair doctors, but I would say that any disability claim will be a problem, with that level of obvious fitness.
