    No way would I view that email as a cancellation - imagine the other way round if you were trying to argue that you HAD cancelled your policy on the basis of that (and wanted money back or something) - an insurance company would say no firm instruction, no date, no return of insurance certificate or acknowledgement that it ceases to be in effect...

    Their letter back demonstrates how weak their case is. So PHEW. She's avoided an IC10 (which is a huge red stop sign to a lot of insurers for future cover). I would present to the police as a mess up by the insurers in cancelling her policy without her formally requesting it and not tell her.

    Once you know the police no longer interested, you could then push for the full amount to be paid back to her?
  • That's kinda the plan at the moment, she took the letter to the police today and they have to let the arresting officer see it and he will decide they told her (?). If the police will accept the first letter which is not the actual indemnity and once we get confirmation that they are cancelling the proceedings, then we will go back to the insurance company and refuse the first offer. BUT the policeman in question is a jobs worth so may insist on the actual letter of indemnity being produced, in which case I'm too scared to risk losing the offer of a letter of indemnity for the sake of a couple of hundred quid. Let's face it she's gonna have to spend much much more on insurance and retaking her test, not to mention the loss of her new job if the insurance company change their minds cos we don't play ball.
  • To clarify - sabre have sent a letter offering to supply a letter of indemnity on production of the police producer, providing we accept the offer of half the costs. If the police will accept this first letter then we have nothing to lose by pushing them for full refund of costs inc cancellation charges, on the other hand if we need the actual letter of indemnity then we have to accept that offer to get it. Not a problem - it's certainly worth it.

    given the circumstances I'd say that offer constitutes unfair bulling/blackmail and, once you have the pending prosecution sorted out, I'd be referring it to the FOS

    Really it's black & white....

    either the cancelation was valid in which case the OP gets an IN10 and has to fund the impound and other consequential themselves

    or it wasn't valid and the insurers need to do the letter of indemnity so the OP avoids the IN10 and the insurer also needs to pick up all the costs.

    The idea that it was a valid cancellation but the insurer (out of the goodness of their heart!!) will do an indemnity letter so that the OP can avoid an IN10 is just silly and probably close to perverting the course of justice

  • Still waiting to hear from the police. Phoned today but the arresting officer was not available. They are on the whole very very unhelpful
  • My daughter spoke to the arresting officer yesterday, he wants to investigate why the insurance company are suddenly prepared to offer indemnity and says he will contact them by the end of the week.
  • Still waiting to hear from the policeman. He said he would contact the insurance company by the weekend. Daughter is going to ring tomorrow . Will be 2 weeks on Thursday since we handed letter in.
