Also on researching online, sabre who own go girl have a shocking track record for cancelling policies and adding charges after they have been taken out0

This is her email, it's very bad and I don't think it gives her a leg to stand on. I think It is going to hinge on wether it is reasonable that she wasn't given notice of either the cancellation, or the charges they levied without notice. I'm not trying to say she didn't do it , she did, she made a huge mistake and there is no doubt about that. I'm looking for any tiny little thing that may help her that's all.
Hello, i am looking to cancel my car insurance with you, I currently have policy ref *****.
My reasons for wishing to cancel are based on current research. I am about to start a new job so therefore need to adjust my insurance to meet that. The adjustments will be adding 1000 miles annually, changing my occupation to check in services at an airport, taking my additional drivers off the insurance and including commuting in my insurance which has reduced my annual fee by up to £800 with numerous other companies, however when i have looked at go girl it has increased by around £70.
Regards

I think a solicitor will have an argument to make with a reasonable chance of winning. I would formally dispute the matter with the Insurance provider asap.
Had I received such a letter I would have viewed it more as an invitation to offer me a better deal. As has been said its not in the form required to cancel as it makes no statement about the policy. And "looking to cancel" is just that: considering the possibility of it.
Another factor is that the insurer has little to lose by re-instating the policy (assuming the refund is repaid) since there was no insurance loss. But if you pursue the complaint through the regulator they will incur costs so I see you have little to lose and everything to gain.
Worth getting legal advice too of course.
That said if the cancellation is not legally valid you might have a claim against the insurer for that!Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0 -

I agree (except that the regulator is not what you need, it is FOS).
The process is to go to the Financial Services Register, find the insurer, find the contact details (or Basic Details).
Get a fax number if possible (and you have access to a fax or fax modem). That gets an instant acknowledgement. If not, e-mail is good but follow up with a letter, keep a copy and get proof of posting (free from the Post Office).
Make the full case. You cancelled without telling me simply because I made an enquiry. As a result of your error I am being prosecuted and my car has been impounded. What are you going to do about it?
They have eight weeks from receipt of the complaint to respond.
Only when you receive the response or the eight weeks have passed can you go to FOS.
Hopefully the insurer will resolve it before then, though.0 -
Thank you so much, we have composed a letter and will email and post a copy tomorrow. Will let you know if thee is any progress:beer:0

If you can afford it, best to post using a "signed for" service given its importance. A certificate of posting helps but firms have been known to claim that proof of posting is not proof of receipt. Its not free but you do get the signature of the person receiving it recorded by Royal Mail.
I had a problem returning some goods which the firm tried to deny the proof of posting was sufficient proof of delivery.Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0 -
and obviously opt for court/seek adjournments for the pending prosecution0

Much as it's probably not what the OP wants to hear, that reads to me like a pure and simple, clear cut, notice of cancellation.
If I worked for Go Girl and read that email, I can't see anywhere in there saying "if you can't do me a better deal, I'll have to cancel", or "I'm thinking about cancelling". It just says "I'm looking to cancel", so they've done exactly that.
Of course, that said, good luck to the OP with getting it all overturned - it's obviously a case where no malice or misintent has been involved.0 -
I am afraid I agree with the above poster - the email clearly says 'I am looking to cancel' not I am looking to see if you can give me a better quote'."'Cause it's a bittersweet symphony, this life

I'm a third for the that looks pretty clear to me it is a cancellation email but given the formalities that need to be complied with for it to actually cancel the policy then no harm in pursuing a complaint.Thinking critically since 1996....0

A bit sloppy that they cancelled the policy without having the date the policyholder wanting it cancelling from, didn't give her the amount of the refund and didn't then confirm that she wanted to proceed.
I would have thought at least they should have replied to her email to confirm the cancellation had taken place and asked her to return the certificate.
Worth putting in a complaint.0
