Sounds as if your only chance is for her Defence Agent to plea 'Special Reasons' at court but this will depend on the content of the email methinks.The highest form of ignorance is when you reject something you don't know anything about.

Thank you for your replies, we are fully aware she has been rash and foolish and she is bitterly sorry and going to pay massively for her actions. Does anyone know if it is a set 6 points for this offence or is there some discretion allowed by the police?0

My bad, when I tried to cancel my insurance due to car dying the insurance guy said no point cancelling for 2 months left and said to let the cover expire normally as he said it'd go against me if I cancelled it.
Sorry for confusing the OP and others.
It would have gone against you in that you may have paid more than the yearly premium to cancel at such a late date. And lost a years worth of no claims. Not as having to declare that you cancelled it.Censorship Reigns Supreme in Troll City...0 -
If she accepts the ticket then its a standard 6 points. She needs legal advice to see if its worth going to ourt and fighting it.
Although that maybe costly. And not 100% certain.
But getting insurance with 6 points for no insurance wont be cheap. Add on the costs for another driving test etc.Censorship Reigns Supreme in Troll City...0 -

As well as looking at the wording of her email you need to read her policy and see *exactly* what is required for her to cancel the policy.
Mine requires that I need to return the certificate (or make a stat dec that it's been lost) before I can cancel it.
If hers is the same then I'd be arguing (via their complaints procedure/FOS) that the insurers shouldn't have cancelled it and so it is still in force and all the bad bits can be unwound.
Looking at her policy, it says
so you really need to read the email she sent and see if you can make an argument that the required acknowledgement wasn't given/ certificates weren't returned......Standard Cancellation Terms (beyond the Cooling Off period)
You may cancel the Policy in writing at any time providing you return all Certificates of Motor Insurance. In accordance with The Motor Vehicles Order 2010 (Electronic Communication of Certificates of Insurance), you are authorised to notify us, via email, of your intention to cancel the policy, acknowledging that the Certificate of Insurance has ceased to have effect from the appropriate time and date.....0 -

She told them that she had been getting prices and that she was looking to cancel her insurance as theirs was much more expensive.
Is the above an accurate precis of what she said in the email?This is an open forum, anyone can post and I just did !0
