That's my thoughts as well - in the email, OP's daughter doesn't state that she has actually arranged insurance elsewhere, and does not give a date on which to cancel the insurance. In the absence of any confirmation from the insurer, she has no way of knowing what the status of her insurance is at any given time.
If it goes to the Ombudsman, their usual modus operandi is to take all the correspondence and deduce what the most likely intention was. In this case, with no confirmation of cancellation from the insurer, I can't see how she could be expected to know that her policy had been cancelled.0 -
I suppose my question for OP is why had she not followed up on her "unanswered" email ?0

Letter received this morning from sabre, they say her email constitutes a request to cancel but as a gesture of goodwill they will provide a letter of indemnity covering her for the date she was stopped to give to the police and refund half our costs for recovering the car. The police say they need a copy of the letter for the officer concerned to sign the case off. I'm too scared to even hope that this is the end of it... :eek:0

Good result but I'd be confident that you could get more if you pushed/go to FOS as the email certainly doesn't comply with the policy T&C as far as cancellation goes so you should be able to get all your costs back.
Having said that, a bird in the hand etc0 -
In that position i would be so relieved at not losting my licence and having to declare 6 points for no insurance i would be too busy celebrating to think about the money side of it. And future cover.Censorship Reigns Supreme in Troll City...0

Have to say do not feel inclined to push our luck,and just not counting chickens until the police confirm that they will drop the case. I guess even if they don't the letter from sabre will stand her in good stead in court0

That letter means that she cannot be found guilty of driving without insurance on the day in question!
Don't be taken in by the "goodwill gesture", tell them that if they won't refund all the costs you incurred you intend to escalate to the FOS.
You will find their goodwill gesture will "grow"!0 -
