We have had nothing from them apart from the slip of paper he gave her when he took her car.

What did the slip of paper say?
  • Just stumbled across this post, but just something to note is that my current insurer stores the certificates online now instead of sending them in the post. They offered this to me when I changed my car over this year. The insurer is Admiral.

Think about it: Even if you produce an insurance doc to the police at the roadside, they still phone the insurer concerned, because most insurers will cancel a policy without having the certificate back, and if the insured has not kept up monthly payments on a payment plan, they will terminate the insurance too, without needing the certificate back. The certificate means nothing these days. Even the post office doesn't need the cert to tax your car now as far as I know (I do it online). And even car tax will no longer need paper proof soon, with monthly payments coming in later this year.
Could HAVE. Should HAVE. Would HAVE. Not OF.

Think about it, they will have checked MID before they stopped you.

Have a read at The Motor Vehicles (Electronic Communication of Certificates of Insurance) Order 2010 if you are bored.

It's a police seizure notice, it says on 30th jan at xxx a vehicle xxx was driven by you xxx without there being a valid certificate of insurance certificate . The vehicle has been seized and will be taken to xxx and instructions on how to get it back
On the back it says in small print the offences that you have committed will be dealt with I the following manner:
You will be reported for summons and will receive a summons to attend court through the post. The information sent to you will explain what your responsibilities are in relation to this.

This is the only thing we have had to date

In my view that has to be a prosecution pending, until the police tell you otherwise.

.......Does she need to declare to the insurance that she has a pending prosecution?.....

She only has to disclose this if asked.

Not all insurers ask about any pending prosecutions.

So if she needs urgent cover she can get it from any insurer who only asks about convictions/bans/points etc and doesn't want to know about current pending prosecutions.

Not a recommendation, but direct line don't ask.

Still waiting for the police to decide about the letter of indemnity which we handed in last Thursday. Getting beyond a joke

What I cannot comprehend is why this is happening. The fuzz have only a limited amount of time to take action, and on the issue of seizing your car they cannot do this arbitrarily. I'm not clear on the timeframes, but if you have had no response or notification of action after 21 days, take it to a solicitor or write to the Chief Constable stating the saga is unacceptable.

If they cannot be bothered to deal with the issue in a timely manner, they lose the right to do anything. You'll also be charged for storage on a daily rate, and these costs will be punitive.

No point offering advice if you haven't bothered to even read the op!

You would then know there is no ongoing storage.

And if you had read on you would see the police did tell her what was happening.

The OP is hoping to nip it in the bud by contacting the police and showing the indemnity letter she got after the event.

The limited amount of time the police have to lay this before the court is 6 months. (Also posted in the thread).

There is no point the op spending money on a solicitor to give the police or chief constable a kita at this early stage.

yep, but the repeated failure to return phone calls might be worthy of a complaint and get it resolved
