I sent them a letter back in July which my solicitor confirmed that it conformed to their cancellation criteria. I had a prompt reply to the first two incorrect letters but they've ignored my latest one.Suziedoggirl wrote: »Can I ask anyone who reads this to let me know if PHS has ever sent them a letter of notification re price increases?
They say that these letters have been sent to every client but as I ask around I find that not one company has ever recieved one. After requesting copies of the price notification PHS has sent me (and 3 other companies) "copies" that are so full of inconsistencies it's laughable. These "copies" go back to 2009. They say a price increase is on the way and explain why. I would really appreciate as much response as possible on this as we will be taking PHS to the small claims court and I believe they are guilty of fraudulent activity. I also believe that as these letters have not been sent they are in breach of their own terms and conditions.
I've been with them since November 2005 when they acquired Shift It and I haven't once seen a price increase notification.0 -
Trading standards told me just don't pay it. They weren't too keen on actually helping but said "if you don't think it is fair, don't pay it" they would have to go to court and I think so far have lost everytime. Just join the FSB and they know all about these cowboys! Wastetech has also just lost all the school contracts - they have lost so much business. We should get the papers to write an article about these people. I have to stop myself from going into the shops where I see the bins to tell the owners!Help me to help you :santa2:0

Having just been through a battle with PHS I am happy to give advice on how to come out best against this seriously hated company! Their contract is nasty and they do not care about basic customer service. I will never advise anyone to use this company,0

I've just received what should be my penultimate bill from PHS and have noted that it had gone up by £26 (about 30%) despite only having 4 collections in October compared to 5 in September.
**edit just worked it out properly and each lift has gone from £12.30 to £20.80 which is a 65% increase!!!!!0 -
PHS Bandits
i signed a contract with them for £34 in 2010(i wish i had googled them first) now its £104 thats 300% increase there is an increment every 3-6 months. I am looking for early termination, surely they cannot justify this.We need something like class action against these rogues.0 -

I have cancelled my contract with PHS. PHS have always managed to send an invoice on time, but have never managed to send a price increase letter. Havving eventually requested a notification letter my business contract lawyer says it is not valid as the letter does not state the customers new price increase. Furthermore your invoices with PHS has become less and less transparent, as it no longer shows your price per lift. (unless you ask for admin copy). Cancel your direct debit and continue to pay what is the appropriate price until they have provided you with the price increase notification. Also ignore all their threats. Just make sure you continue your contract till the very end providing them with 3 months notice stating the correct termination date (which is anniversary date or commencement date as per your contract). Write to them and state you will not pay more than what is reasonable. PHS have the duty to continue the service, if they refuse to collect your waste you can report it to environmental health, if they still refuse them you can cancel the contract completely as they have not fulfilled their side of the contract. Make sure you follow the terms by the letter and you will easily survive in court.0 -
Hi
Im also tied to this disgusting company unti Jan 2013.I even once had to pay £70 for what they classed as a "pre acceptance notification". What that actually meant was that the government was bringing out a bit of new legislation and I had to sign a letter to agree to it. Of course we have to abide by government legislation anyhow but to be charged £70 just for signing your name on a letter is disgusting.
My last "waste transfer note" cost me £270 and its soon due again so Im expecting a huge increase. The thing is its passed off as note transfer/administration charge. Surely an administration charge has to be justified? Am I forced to even pay for a transfer note when its free to download anyway? Would anyone know how to get round this charge? This company is massively eating into the small profit I make. Thanks for any advice in advance.0 -
Totally agree Robert. Wastetech are a rip off. We arranged a price with them which they increased twice without informing us in advance. First time it was resolved - second time they would not budge.
I told them they were in breach of contract which states they will inform us of any price increase. They said that the invoice was their method of informing us of price increase!! I had the same pathetic runaround to cancel and was told I would have to spend about £2000 to settle the annual contract including an unpaid £200 invoice.
In the meantime we changed to Team Waste - never had any problems since... In doing that they charged us with breach of contract for using another waste service provider. After a lot of angry phone calls they finally accepted just the settlement of the invoice and all was done. They have had the cheek to try and get our business back since - absolutely no chance!!
Their invoices no longer show any prices for their pickups or provision container charges, The scary thing is they are doing this on purpose as I once contacted the office for a copy of their invoice, they accidently sent me their own copy which was fully transparent with every single price explained in detailled...!!!!!0 -

I cannot comment on your issue as I have not really bothered about this stage. All I can say is refused their cardboard collection service. They are making money out of recycling it and still charging the customer. Next check for any price increases, this is difficult to calculated with their less transparent invoices and their inability to provide notification on this. If they do raise their prices tell them they did not give notice. Then again you would need to speak to a lawyer and find out if this is enough to claim they have broken contract. Also check they do not overcharge you on lifts.
Good luck0 -
They are tying me into a 3 year contract and asking for money including the infamous annual fee of £237, even though I have never had a bin from them and NEVER HAD ANY COLLECTIONS OR WASTE SERVICES FROM THEM. I did stupidly sign a contract in June 2010 which was faxed to them, but they kept calling me asking me to send back the original signed contract, which I never did, so I assumed I had not signed an official contract. Within a few days of signing I emailed the sales rep to say that I have discovered I could not get out of my existing waste contract as I had not realised I had to give 3 months notice, and said that I wanted to cancel the request to start the service with them, as I was still in contract with my existing provider, but I asked them to put this on hold because the person that could confirm the information was on holiday. I therefore emailed back to them a few weeks later to say that I was definitely still in contract and could not commence the service with them. The rep suggested that we start the service the following August 2011, if I could give notice to my existing supplier in May 2011. I said I would get back to them in May to confirm this. As I was already experiencing their poor service, including receiving invoices for services never provided, plus the notorious annual waste transfer admin fee, I decided not to change to them, and therefore did not give notice to my current supplier but just continued with them. The saving would have been a few pounds monthly, but with the annual fee added it would have been far more expensive, so I decided not to change. In the interim I have written about 20 letters and emails to them confirming that I do not want their services and besides they have never provided a service to me, so how can they charge for something not provided. They are now saying that I never gave the correct wording to terminate the contract and therefore it is still valid until 2013, and they are going to pass it to their legal department and it will go to court. They said they did not cancel the contract but deferred the start date until the August, but I never did give them the go-ahead. They have never collected the monthly fee by direct debit, and after I complained about the first year's annual fee, so they credited it back to my account, and have never collected any other amounts, but have issued invoices from time to time. They say in order to get out of the contract I would have to pay all the outstanding charges up to June 2013, which I do not intend to do. As far as I am concerned I do not have a contract with them, and have never had one single service from them.
I today received a letter from their legal department offering a settlement figure of £950, which is equivalent to 3 years monthly fees. I do not want to pay anything to them for something that I have received or will never use. Any advice please, as they want a reply within 10 days
